Jersey Aircraft Registry: Law: Establishment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

Establishment of a Jersey Aircraft Registry to increase the suite of offerings the Island can extend including the Jersey Shipping Registry.

 

Development of an Aircraft Registry (Jersey) Law, the primary legislation for the operation of the Jersey Aircraft Registry and any other supportive legislation to enable the establishment and operation of a Jersey Aircraft Registry

The Minister made a policy decision to establish a Jersey Aircraft Registry

Reason(s) for Decision:

 

The Minister made a policy decision in September 2013 to establish a Jersey Aircraft Registry, following a joint political decision with his counterpart, the Minister for Commerce and Employment, in Guernsey not to proceed with a joint Channel Islands Aircraft Registry.

 

A Working Group has been established with key personnel from both the private and public sector, under agreed Terms of Reference, to develop and establish the ideal operational model for the Jersey Aircraft Registry in early 2014, alongside the development of the necessary legislative framework to support the Registry.

 

This decision will allow the immediate commencement of drafting the Jersey Aircraft Registry legislation

Resource Implications:

 

While a decision is still needed to be made on the preferred operational model, it is envisaged that the Registry established will have little on-going resource implications once the set-up phase has been completed

Action required:

  • The establishment of a Jersey Aircraft Registry Working Group; and
  • A request for law drafting time to develop the necessary legislative framework to establish the Jersey Aircraft Registry
  • The Minister to sign and date the Ministerial Decision and for it to be returned to the States Greffe.
