Island Plan 2011: Revised Draft Revision - Approval (P.37/2014 Amd. (12)) - Twelfth Amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

Having considered those amendments from States Members, the Minister for Planning and Environment:

  1. resolved to prepare and submit his own amendments in relation to P.37/2014 Amendment 8; and P.37/2014 Amd.11 Amendment; as well as submitting his own amendment to widen and clarify the definition of States-owned land as it appears in the proposed changes to the Island Plan in relation to the delivery of housing; and in so doing;
  2. the Minister endorsed the content of his amendments to those already submitted and referred to above, as well as the content of his own amendment related to the definition of States-owned land.

Reason(s) for decision:

  1. The Minister wishes to ensure that the proposed changes to the Island Plan best meet the Island’s planning objective; and,
  2. that the housing strategy set out in the proposed revision to the Plan remains deliverable.


Sustainability appraisal:

Environmental implications: The Minister’s comments have addressed the environmental implications of the proposed amendments.

Economic implications: The Minister’s comments have addressed the economic implications of the proposed amendments. Where the Minister is proposing further amendment to the Plan, he is being cognisant of economic concerns that have been expressed.

Social implications: The Minister’s comments have addressed the social implications of the proposed amendments.

The Minister’s proposed amendment to the definition of States-owned land seeks to ensure that the social objective of meeting the Island’s need for affordable homes can be delivered by the proposed changes to the Plan.

Legal implications: The Minister’s decision is made in accordance with Article 20 of the Planning and Building (Island Plan)(Jersey) Order 2009 and Article 3 of the Planning and Building (Jersey) Law 2002;

Resource implications: There are no resource implications arising from this decision that are not accounted for within the resources available to the Department of the Environment.

Action required:

Request that the Greffier of the States takes the necessary action to lodge the amendments ‘au Greffe’ in order that they might be considered as part of the debate in relation to P.37/2014.
