Metropole Hotel, Roseville Street, St. Helier - Remove Listing as Building of Local Interest.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Acting Minister for Planning and Environment determined that:

  1. Metropole Hotel (C19th house), Roseville Street, St Helier should be removed from the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey;
  2. Whilst not able to exercise any regulatory control over the fate of the c1820s portico through the review of the site’s registration, every effort should be made to salvage this architectural feature in the context of any subsequent redevelopment proposals.

Reason(s) for Decision:

  1. The particular interest of Metropole Hotel (C19th house), Roseville Street, St Helier, as identified and described in the report and relative to the published criteria for selection, does not justify its inclusion on Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey as a Building of Local Interest;
  2. The 1820’s portico is a fine example of such and efforts, through the regulatory development control process, should be made to seek its salvage and appropriate re-use in the context of any redevelopment proposals.

Legal and Resource Implications:

The inclusion of buildings and places in the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey is consistent with the purposes of the Planning and Building (Jersey) Law 2002.

Action required:

  1. Notify the owner
  2. Update the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey
  3. Notify Development Control
  4. Acting Minister to write to Minister of P&E to express his hope that the Minister might seek the salvage of the 1820’s portico through his planning powers in the context of any subsequent development proposals.
