Castle Quay: Amendment of Planning Consent

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Amend condition No. 3 of the Planning Consent granted which stipulated that the consent would cease to be valid if a Planning Obligation Agreement had not been signed within 6 months of the date of that consent  . 

 

Decision(s):

The Minister agreed to amend the condition to permit the preparation of a Planning Obligation Agreement by the 31st December 2011.

 

 

Reason(s) for Decision:

The Minister has received a request from Dandara Jersey Limited to amend the wording of a condition on the consent granted for the scheme which was considered and approved by the Minister at his meeting of the 29th June 2010. The condition reads as follows:

This consent should cease to be valid should a formal Planning Obligation Agreement under Article 25 of the Planning and Building (Jersey ) Law 2002 not have been submitted to and approved by the Minister for Planning and Environment 6 months from the date of this consent. This Planning Obligation Agreement shall cover:

The contribution to sustainable transport - £68,935.

 

The contribution to Percentage for Art - £265,610.

 

The Minister recognises that the delay in the negotiation of the purchase of the land by the applicant has resulted in a subsequent delay in completing a Planning Agreement. He is also aware that work on the Planning Agreement is in progress and is satisfied that a further extension of the period within which this Agreement could be completed and signed is reasonable and appropriate in the circumstances. He is therefore prepared to allow the condition no. 3 to be amended so that it would read as follows:

This consent should cease to be valid should a formal Planning Obligation under Article 25 of the Planning and Building (Jersey) Law 2002 not have been submitted to and approved by the Minister for the  Environment by the 31st December 2011.

 

The two contributions to sustainable transport and the PFA remains the same.
