Highbury House, Five Oaks, St. Saviour - transfer to Property Holdings

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister agreed to;-

a. Authorise the transfer of administration of the Highbury House site to Property Holdings;

b. Authorise the virement of the accrued costs in respect of the proposed development to Property Holdings;

c. Seek the agreement of the Treasury & Resources Minister to a and b above.

Reason(s) for decision

As the site will not deliver homes for social rented purposes the development will be more properly undertaken by Property Holdings

Transfer of Highbury House Site, Five Oaks, St Saviour to Property Holdings

Background

Highbury House, Five Oaks, St Saviour is a Publicly owned site acquired by compulsory purchase on 12th April 1996 and which adjoins the site of ‘Stranton’ also owned by the Public. The conditions of the compulsory purchase order require that the site be developed for housing purposes.

Stranton is under the administration of Property Holdings whilst Highbury remains under the administration of the Housing Department.

A scheme is in the process of design for the two sites (Highbury & Stranton) in order to deliver two first time buyer family homes.

Following the creation of Property Holdings, the Housing Department now provides a purely a social rented housing function and it is suggested that the development of these sites purely for first time buyers would be more appropriately undertaken by Property Holdings who are in any case providing the Architectural services for the proposed development. It is proposed that expenditure in respect of the design fees for the development be transferred with the site although it is not proposed that any sums should be payable by Property Holdings for the Highbury site itself. The net sale proceeds will form part of the annual efficiency ‘savings’, rising to £4 million per annum, that Property Holdings must deliver to fund expenditure proposed in the States Annual Business Plan.

Discussions have taken place with Property Holdings who have indicated that the transfer of the site for development by Property Holdings would be supported.

Recommendation

That the Minister;-

a. Authorise the transfer of administration of the Highbury House site to Property Holdings;

b. Authorise the virement of the accrued costs in respect of the proposed development to Property Holdings;

c. Seek the agreement of the Treasury & Resources Minister to a and b above.
