Sea Fisheries (Fisheries) (Jersey) Regulations 200-.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

UK Secretary of State approval for draft Sea Fisheries(Fisheries)(Jersey) Regulations 200_

Decision(s): 

The Minister approved that the draft Sea Fisheries(Fisheries)(Jersey) Regulations 200_ be sent through the official channels for UK Secretary of State approval.

Reason(s) for Decision: 

Approval of the UK Secretary of State is a legal requirement and an obligation under the UK/Jersey Fisheries Management Agreement before the draft regulations can be approved by the States. 

The draft regulations will determine the procedure concerning application for and granting of a licence to establish or maintain a fishery in the sea landwards of the outer limit of the extended territorial sea adjacent to Jersey.

ECONOMIC DEVELOPMENT  

SEA FISHERIES (FISHERIES)(JERSEY) REGULATIONS200_  

Purpose of the Report  

To agree that the draft Sea Fisheries (Fisheries)(Jersey) Regulations 200_ are forwarded to the Secretary of State for approval before being presented to the States of Jersey. 

Background  

The current regulations which used to administer fish farming - Sea Fisheries (Establishment and Regulation of Fisheries)(Jersey) Regulations 1998  - needed modernisation in a number of areas and in particular needed to ensure that any applicant has a sufficiently close association with Jersey. Once drafted any Fisheries legislation done under the Sea Fisheries (Jersey) Law 2004 needs Secretary of State approval before being put before the States of Jersey. 

Details  

The legislation has relied on all the licensing powers and powers of officers in the Law and so these powers have been omitted from the new regulation. It ties the applicant to having a close association with Jersey and gives the Minister powers to determine that the application is in the best interest of Jersey. 

The protection of the fishery is also increased by dropping the exemption of navigating in the area as a defence for a person causing damage to the fish farm in any way.  

Recommendation  

The Minister requests Crown Officers to send the draft Sea Fisheries(Fisheries)(Jersey) Regulations 200_ through the official channels for UK Secretary of State approval.
