Information about the publication of Ministerial Decisions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Proposed amendments to the Part 6 requirements of the Building bye-laws (Jersey) and the Technical Guidance published in support of those requirements.

Introduction.

Part 6 of the Building Bye-laws and the supporting approved Technical Guidance, provides a regulatory framework and guidance on the design of buildings with respect of drainage, hot water and sanitary provision in buildings. The currently approved technical guidance (ADH and TGD 6) was last updated in 2004. In accordance with the Department’s 2013 business plan it is proposed to update the current guidance in line with changes made to British Standards resulting from the move to harmonised European Standards and take the opportunity to encourage improved water efficiency by setting performance standards for water fittings in newly constructed dwellings.

Proposed amendments.

The main changes are:

To combine the current approved guidance given in the Approved Document H and the Technical Guidance Document 6, in one single Document.
General revisions to reflect changes to British Standards resulting from the move to harmonised European Standards.
Updating of guidance to reflect the changes made to the bye-laws that allow on site wastewater treatment systems.
Requirements relating to hot water storage amended to limit the temperature of hot water delivered to a bath in a newly created dwelling to 480 c.
Guidance added on the use of chemical and composting toilets.
New requirement aimed at improving water efficiency in newly constructed dwellings.

Legal and resource implications

Article 31 (2) of the Planning and Building (Jersey) Law 2002 empowers the Minister to make Building Bye-laws, relating to the provision of services in buildings and to publish guidance in support of such requirements. The proposed amendments involve relatively minor changes to the current provisions and as such there will be no departmental resource implications arising from the amendments.

Recommendation

It is recommended the Minister:

Approves the issue of the consultation document referred to in sub-paragraph 7 above, for public comment.
