Infrastructure, Housing and Environment: 2022 DVS Fees and Charges

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister for Infrastructure approved the regulatory related fees and charges as set out in the attached schedule.

 

Reason(s) for Decision:  To enable the Department to increase its regulatory related fees and charges by an average of 2.5% from 1 January 2022 to aid cost recovery.

Resource Implications:  The additional income resulting from the proposed increases to infrastructure related fees and charges will aid the Department in cost recovery.

 

Action required:  The Head of Finance Business Partnering to arrange for the Department’s regulatory related fees and charges to be advertised on www.gov.je.

The Registration Manager to request the Principal Legislative Drafter to prepare the necessary orders.

2022 DRIVER AND VEHICLE STANDARDS FEES AND CHARGES

 

 

Purpose of Report

 

The Minister for Infrastructure is asked to approve a request to amend the Department’s regulatory related fees and charges for 2022 (a schedule of charges is attached as Appendix A).

 

 

Discussion

 

The proposed increases have been limited to 2.5% per annum in line with the anti-inflation policy, except for the fees listed below and detailed in the attached appendix.

 

Where appropriate Driver and Vehicle Standards charges have been rounded to the nearest £0.50 to aid an efficient cash handling process. The fee for Compulsory Basic Training has been raised by September’s RPI(Y) (2.7%) in line with the contractual arrangements with the service provider.

 

 

Recommendation

 

The Minister is recommended to approve the fees and charges for 2022 as laid out in the attached Appendix A. The Minister is recommended to request the Head of Finance Business Partnering to arrange for the Department’s fees and charges to be advertised on the States Website, www.gov.je, and to be available on request from the department.

 

That the Minister requests the Registration Manager to request the Principal Legislative Drafter to prepare the necessary orders.
