Information about the publication of Ministerial Decisions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):	The Minister for Planning and Environment resolved to serve a notice of his intent not to List the building and/or place specified above.
Reason(s) for decision:	The special interest of the building and/or place specified above, as defined and in the schedule and relative to the published criteria for selection, does not justify its inclusion on the List of Sites of Special Interest as a Listed Building or Place in accordance with the provisions and purposes of the Planning and Building (Jersey) Law 2002.
Legal and resource implications:	Article 51 of the Planning and Building (Jersey) Law 2002 enables the Minister to include on the List of Sites of Special Interest those buildings and places that the Minister is satisfied has public importance by reason of the special archaeological, architectural, artistic, historical, scientific or traditional interest that attaches to the building or place. Article 52 of the same Law requires the Minister to serve Notice of his intention to do so. There are no additional resource implications of this decision.

This report has been prepared by Jersey Heritage as part of its responsibility under a Service Level Agreement to provide reports and recommendations to the Minister for Planning and Environment on the architectural, historical, archaeological and other significance of buildings and places.

The assessment undertaken and the recommendation given in relation to the above building and place is made under the auspices of Article 51 of the Planning and Building (Jersey) Law, 2002; and the criteria for the listing and grading of heritage assets adopted and published by the Minister for Planning and Environment.

The report also includes the views and advice offered by the Listing Advisory Group in relation to the assessment of this building and place.

Special interests of the site

The building scheduled in this report is of inadequate historical, architectural or other interests and does not satisfy the published criteria for Listing.

Late C19 / early C20 shop. 3 storey, 2 bay. Front, north elevation: Roof unseen behind parapet. Rendered chimney to east gable. Walls rendered, side pilasters with ashlar effect. Flat, shouldered hoods to 1st and 2nd floor windows. Brackets to moulded 2nd floor cills. Windows; 2nd floor 2 pane (1/1) sashes, with horns. 1st floor 6 (2:2:2) pane metal framed top and bottom hinged. Original first floor windows knocked through to form single enlarged opening - render detail altered to match the others. Shop front modern replacement.

Advice offered by MLAG (and others if stated)

MLAG discussed the grading of this building at their meeting on 06/02/2012. Members proposed that the building scheduled in this report should be listed as grade 4 for its streetscape value.

Jersey Heritage recommendation

De-list. This modest building makes some contribution to the character of this block of King Street with its late Victorian / Edwardian articulation and decorative features, but the alterations to the shop-front and first floor window openings reduce its integrity and interest.
