Various leases for the harbour area.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: St Helier Harbour leases - PG 1654/8, 1669/19, 1669/22, 1669/45, 1713/1 - E16, V24, V26, V32A, LB1AA, A55 & V55

Decision(s): 

  1. The Minister accepted the recommendation of the Minister for Economic Development in respect of the following:

 

  1. Elizabeth Harbour (Ground site) E16 – Lease to Condor Jersey Ltd for a period of 5 years, with effect from 1 April 2008.

 

  1. Victoria Pier V24 (Ground site) – Lease to Mrs J O’Brien for a period of 3 years 2 months, with effect from 1 November 2008.

 

  1. Victoria Pier (Workshop/store) V26 – Lease to Premier Services Marine Engineering Ltd for a period of 5 years, with effect from 1 October 2008.

 

  1. Victoria Pier (Bunker Vivier) V32A – Lease to Aqua-Mar Fisheries Ltd for a period of 5 years 1 month, with effect from 1 August 2008.

 

  1. La Collette (Ground site) LB1AA - Lease to GT Marine Ltd for a period of 3 years 2 months, with effect from 1 August 2008.

 

  1. Albert Pier (Ground site) A55 – Lease to Pure Adventure Ltd and Island RIB Voyages for a period of 3 years 1 month, with effect from 1 September 2008.
  2. Victoria Pier V55 (Store) – Lease to Clean 24/7 for a period of 3 years 1 month with effect from 1 September 2008.

Reason(s) for Decision: 

1.  Under Standing Order 168 (1) (a) and 168 (3) the Minister hereby notified the States that he had accepted the recommendation of Property Holdings to agree to the above land transactions.

Resource Implications: 

Other than those detailed in the report attached and the decision of the Minister for Economic Development there are no further financial or manpower Implications.

Action required: 

1. In accordance with Standing Order 168 (3) this decision must be presented to the States at least 15 working days before the contract is passed.  After the expiry of 15 working days following presentation to the States the transaction may be concluded. 

2. The Director of Property Holdings is to pass any contract which is required to be passed on behalf of the Public, and to copy this decision to the Minister, Treasurer and Deputy Treasurer.
