Information about the publication of Ministerial Decisions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

THE JERSEY MOTOR CYCLE AND LIGHT CAR CLUB’S APPLICATION TO

HOLD THE JERSEY CAR RALLY 2013

1.0 Purpose of the Report

To obtain a Ministerial Decision regarding approval of road closures and traffic restrictions for the purpose of holding the Jersey Rally on Friday 11 and Saturday 12 October 2013.

In addition, to enable an instruction to be sent to the Law Draftsman requesting preparation of an Order under Article 2 of the Motor Vehicle Races (Jersey) Law 1946.

2.0 Background

The Jersey Motor Cycle and Light Car Club (the Promoter) has submitted details of its proposed ‘Paperclix Rally’ for 2013. The event is enabled by Order of the Transport and Technical Services Minister under Article 2 of the Motor Vehicle Races (Jersey) Law 1946.

The Promoter has consulted with the Connétable of all Parishes within which stages of the Rally are to be held and has provided TTS with signed certificates of support in each case. They have also consulted property owners directly affected by road closures and supplied proof of Public Liability Insurance.

3.0 Discussion

Of the various main road sections included in this year’s Rally (see attached Rally Stage Plans & Schedule) all the stages have been utilised in the last two to five years, although there are some minor alterations. Most significant with respect to traffic impact will be the following closures:

Archirondel Stage – Friday 11 October between 6.30pm and 10.30pm

The Constable of St Martin was anxious that the start time would interfere with local residents’ attempts to get home. As such he insisted that the time of the stage start was pushed back to 6.30pm. The Constable was also concerned that the stage route itself would inconvenience parishioners by sealing them out of their homes. The Club gave assurances that no resident would be prevented from reaching their home during the stage, but confirmed that they would have to wait to be escorted to their house if their property was on the route. As such the Constable was happy for the stage to take place as planned.

The stage affects - La Route de Anne Port, La Route Le Brun, and La Route de St Catherine (B29 - linking Gorey and St Catherines), Mont de La Mare de St Catherine (B62 - linking St Martins with St Catherines), La Grand Cotil and Le Rue du Villot (B91 - Linking St Catherines with Rozel)

Greve De Lecq Stage – Saturday 12 October between 7.45am and 12.45pm: Le Mont de Saint Marie (B40 linking Greve De Lecq and St Marys village), Le Chemin de L’Eglise (B53 - linking Catherine Best with St Ouens Village)

St. Ouens Stage - Saturday 12 October between 7.45am and 12.45pm: La Route du Marais (B56 – linking St. Ouen’s Village with St Ouens Bay), Rue du Bachelier (B55 - linking St. Ouen’s Village with Les Landes) and Le Chemin De L’Eglise (B53 – linking St. Ouen’s Village with St. Mary’s Village). During this time main road access to St. Ouen’s Village will be limited to Le Grande Route de St. Ouens (A12).

Maufant Stage - Saturday 12 October between 12.45pm and 5.30pm: La Grande Route de St. Martin (A6). During this time access to St Martin’s Village will be maintained via Rue du Hucquet;

The relevant Parish’s are fully aware of the traffic implementations of these stages on Parishioners etc. but have confirmed their approval. Otherwise all stages have been designed to minimise their impact on traffic.

4.0 Public Bus Service Impact

For information regarding the impact on public bus services please see the attached ‘Scheduled Changes to Public Bus Services’.

5.0 Recommendation

The Minister is recommended to approve the Jersey Rally and the preparation of an Order under Article 2 of the Motor Vehicle Races (Jersey) Law 1946.

6.0 Reason(s) for Decision

The proposed road closures and associated traffic management are reasonable and justified.

7.0 Resource Implications
