Jersey Law Commission - appointment of chairman

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Chief Minister, having resolved to nominate Mr. Clive Chaplin as Chairman of the Jersey Law Commission, approved the attached report and proposition entitled, ‘Jersey Law Commission: appointment of Chairman’ and requested that it be lodged ‘au Greffe’ forthwith and with a view to securing the earliest possible date for debate.

Reason(s) for Decision:  The States, by Act dated 30th July 1996, adopted a Proposition of the Legislation Committee and approved the establishment of a Jersey Law Commission.  The current Chairman of the Commission, Mr David Lyons, has recently resigned and it is now necessary to appoint a new Chairman.  The Chief Minister nominates Mr Clive Chaplin who has served on the Law Commission since February 2000 and is fully acquainted with the work of the Commission.

Resource Implications:  There are no financial or manpower implications.

Action required:  Request the Greffier of the States to lodge the Proposition for debate.

PROPOSITION 

THE STATES are asked to decide whether they are of opinion - 

to refer to their Act, dated 30th July 1996, in which they approved the establishment of a Jersey Law Commission, and to appoint Mr. Clive Chaplin as Chairman of the Jersey Law Commission for a period of 5 years with effect from XXXX 2010. 
 

CHIEF MINISTER 

 

REPORT 

The States, by Act dated 30th July 1996, adopted a Proposition of the Legislation Committee and approved the establishment of a Jersey Law Commission. The current Chairman of the Law Commission, Mr David Lyons, has decided to step down from his position. The Committee is grateful to Mr. Lyons, who has been an asset to the Commission and is commended for all his work in this regard. 

The Chief Minister therefore nominates Mr Clive Chaplin as Mr Lyons replacement and recommends his appointment as Chairman of the Jersey Law Commission for a period of 5 years with effect from XXXX 2010. 

There are no additional financial or manpower implications for the States arising from this Proposition. 

Mr Clive Chaplin 

Mr Clive Chaplin is Non-Executive Chairman of the Ogier Group, which he joined as a partner in 1994.   

Mr Chaplin completed his BA at Nottingham University in 1974, and he was admitted as a Solicitor in England and Wales in 1977 and subsequently in Jersey in 1986. 

Mr Chaplin is also a Non-Executive Director of the Jersey Electricity Company as well as a Director of a number of other Jersey and Overseas companies.   

Mr Chaplin has been a member of the Jersey Law commission since February 2000 and is therefore fully acquainted with the work of the Commission.  

I therefore urge States Members to fully endorse Mr Chaplin’s appointment as Chairman of the Jersey Law Commission.
