Issue of a Jersey Passenger Certificate and Licence to vessel 'Liberty Lass'.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Issue of a Jersey Passenger Certificate and Licence to UK registered vessel ‘Liberty Lass’.

Decision(s):

The Minister approved the issue of a Jersey Passenger Certificate to the ‘Liberty Lass’ and signed the attached certificate.

Reason(s) for Decision:

The UK registered class VI passenger vessel’ Liberty Lass’ will be acting as liberty boat for HMS Kent during her visit to the Island from 2nd to 5th May 2008.  The vessel’s UK certification does not extend as far as Jersey and therefore requires a Jersey Passenger Certificate whilst it is operating in Jersey waters, to be issued under the  Shipping (Survey and Certification) (No.2) (Jersey) Order 2005 and a licence under Part V of the Boats and Surf Riding (Control) (Jersey) Regulations 1969.  The vessel is used by the Royal Navy in Plymouth, and they have requested that she be used as a liberty boat in Jersey.

Action required:

Issue the passenger certificate to the ‘Liberty Lass’ upon her arrival in Jersey and ensure that the vessel is aware and understands the certificate’s conditions of issue.

PASSENGER CERTIFICATE & LICENCE

 

Shipping (Jersey) Law 2002, as amended

 

Boats and Surf Riding (Control) (Jersey) Regulations 1969 as amended

 

The Minister for Economic Development,  

 (a) in pursuance of the Shipping (Survey and Certification) (No.2) (Jersey) Order 2005, being satisfied that the provisions of the said Order have been complied with in respect of the passenger vessel 

‘Liberty Lass’

 

Hereby grants a Passenger Ship Certificate in respect of the said vessel;

 

(b)   in pursuance of Part V of the Boats and Surf Riding (Control) (Jersey) Regulations 1969, as amended, hereby grants to –

 

Paignton Pleasure Cruises

27 Roundham Road,

Paignton, Devon TQ4 6DW,

 

being the owner of the said vessel, a Licence for the purpose of the said Part V.

 

The present Certificate and Licence shall be valid only from 2nd May 2008 provided that  

  1. the vessel operates only as liberty boat for HMS Kent during her visit to the anchorage off Jersey, carrying crew and visitors between the St Helier and the anchored vessel;
  2. that the vessel takes the services of a Jersey Pilot for its arrival and departure to and from Jersey and continues to take the services of a Jersey Pilot until the Pilot is satisfied that the vessel’s skipper is sufficiently knowledgeable to safely navigate his vessel on the route between HMS Kent and the Port of St Helier;
  3. that the vessel continues to hold a valid UK class VI passenger certificate and abides by such conditions that apply under that certificate, which must continue to be displayed in a prominent place on board;
  4. that the number of persons carried does not exceed-

i. 50 passengers; and

  1. 3 persons forming the crew;
  1. that an “Emergency Instructions” public announcement on abandon ship procedure is made before each voyage;
  2. that a record of the number of persons on board is recorded ashore, before the commencement of each voyage.

 

This Certificate shall remain in force until 5th May 2008.
