Jersey Arts Trust - appointment of chairman

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Appointment of a Chairman of the Jersey Arts Trust to succeed Mr Colin Perchard, CVO, OBE 

Decision(s):  The Minister approved a draft proposition appointing Mr Alan Le Breton as the new chairman of the Jersey Arts Trust for a four-year term of office. 
 

Reason(s) for Decision: Following completion of the term of office of Mr Colin Perchard, the Jersey Arts Trust conducted an open appointments procedure with the involvement of the States Appointments Commission.  Following interviews for the post, the board unanimously recommended Mr Alan Le Breton as Chairman to succeed Mr Perchard and this has been accepted by the Minister.  The constitution of the Jersey Arts Trust requires the endorsement of the States to the proposal made by the Minister following consultation with the Trust. 
 

Resource Implications:  There are no resource implications. 
 

Action required: The Minister requested that the Greffier lodge the proposition for debate as soon as possible by the States.

1.     Introduction

 

The chairman of the Jersey Arts Trust is appointed by the States of Jersey on the recommendation of the Minister for Education, Sport and Culture after consultation with the Jersey Arts Trust.   The position is vacant and the Trust has completed an appointments process to identify a successor to Mr Colin Perchard OBE, CVO. 

2.     Background

 

The constitution of the Jersey Arts Trust stipulates that the period of office of chairman shall run for four years and may be extended for a second four-year term.  In the case of Mr Perchard that second period expired in April.  Advertising for expressions of interest by the Trust in January this year produced no response but a second advertisement last month attracted two candidates both of whom were considered suitable for interview. 

A panel comprising the outgoing chairman Mr Perchard, Mr Gordon Fitzjohn (trustee), Mr Brian Curtis (representing the Appointments Commission) and Mr Jeremy Harris (Assistant Director, ESC) interviewed the two candidates on 3 June and has recommended to the Minister that he take the nomination of Mr Alan Le Breton, who is the current vice-chairman, to the States. 

Mr Le Breton joined the Jersey Arts Trust board in 2007 after a long career in radio production and journalism.  Born in Jersey and educated at Hautlieu School, he has a wide interest in the arts and became seriously involved in the media at University during the early days of Local Radio. He moved to the BBC’s World Service, covering stories from the Falkands War to the fall of communism, eventually become Managing Editor of News & Current Affairs.  Since his return to Jersey, he has written a regular column for the Jersey Evening Post. 
 
 

3 Next step 

The appointment of chairman of the Jersey Arts Trust requires a report and proposition to the States. 

4.     Recommendation

 

The Minister is recommended to approve the drafting of a proposition to invite the States to ratify Mr Le Breton’s appointment as chairman of the Jersey Arts Trust for a period of four years.
