A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Appeal under Article 108 of the Planning and Building (Jersey) Law 2002 against a decision to grant planning permission, RP/2020/0474, for “REVISED PLANS to P/2019/1647 (Construct 1 No. 3 bed dwelling with associated ancillary structures, parking and landscaping): Extend ground floor level to North elevation. Create roof terrace. Various external and internal alterations to include install 2 no. windows to West elevation and 2 no. windows to South elevation” at Le Rocher Rouge, Les Ruisseaux, St Brelade JE3 8DD

Decision:

The Minister allowed the appeal and refused to grant planning permission, reference RP/2020/0474, for the following reason:

 

1. The proposed development, by virtue of the extent and proximity of roof terrace to nearby residential properties, would be likely to result in an unacceptable impact upon the amenities of nearby residents as a result of noise, general disturbance and loss, or perceived loss, of privacy. The proposal is, therefore, contrary to Policy GD1 of the Adopted Island Plan 2011 (Revised 2014). 

 

Reason for Decision:

The Minister gave full consideration to the assessment and recommendation of the Inspector as detailed in his report to the Minister.

 

However, the Minister also considered that the proposed roof terrace, which would create a significant area of outdoor living space, would be in such close proximity to the neighbouring home and its principal rooms that the use of the terrace would be likely to result in unacceptable levels of noise and general disturbance to occupiers of that home.
