A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

TRANSPORT AND TECHNICAL SERVICES

ROAD TRAFFIC (PUBLIC PARKING PLACES) (JERSEY) ORDER 2006 – AMENDMENT

Purpose of the Report

To regulate two public parking areas in the Parish of St Peter.

Background

The Connétable of St Peter has written to the Department requesting the Minister for Transport and Technical Services to amend the Public Parking Places Order to make the Parish Hall Car Park subject to a 12 hours in any continuous period of 24 hours waiting limit and to restrict the un-named road that runs between the Gunsite Slipway and La Route de la Haule to a 4 hours pay card parking limit.

Discussion

The request with regard to the Parish Hall Car Park is considered necessary to prevent motorists from parking in the car park for prolonged periods of time.

The request with regard to the un-named road that runs between the Gunsite Slipway and La Route de La Haule is considered necessary to regulate the length of time that motorists are permitted to park in this road. The Parish wish these parking spaces to conform with those outside of the Gunsite Café, on the seafront, which are also currently subject to a 4 hours pay card parking limit.

These parking restrictions would be administered by the Departments’ Parking Control Section.

The Minister is requested to approve the attached Draft Road Traffic (Public Parking Places) (Order) 2006 with the two amendments highlighted.

Recommendation

The Minister is requested to approve the Amendment, to be effective from seven days after the Order is made.

To regulate the parking in the Parish Hall Car Park and the un-named road that runs between the Gunsite Slipway and La Route de la Haule.

Action Required

The Minister to instruct his officers to process the Ministerial Decision.
