Funds transfer between Transport and Technical Services and Jersey Harbours.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for Decision:

Under Financial Direction 3.6 and Article 15(1)(a) of the Public Finances (Jersey) Law 2005 the approval of the Minister is required for any variations to heads of expenditure above £100,000.

Resource Implications:

Transfers of £450,000 from revenue to capital being part-repayment by Jersey Harbours of a temporary loan.

Action required:

Head of Decision Support to notify the Minister for Transport and Technical Services of this decision. 

Treasury staff to action the appropriate budget virement.

Transfer between T&TS Revenue and Capital Heads of Expenditure for 2009 Jersey Harbours Repayment

Purpose

To enable the Minister to approve the transfer between T&TS Revenue and Capital heads of expenditure for 2009 Jersey Harbours repayment.

Background  

The Transport and Technical Services Department wishes to transfer £450,000 from revenue to capital heads of expenditure. The transfers are necessary due to a part-repayment of a temporary loan to Jersey Harbours. The attached ministerial decision and report provide full details.

Recommendation  

It is recommended that the Minister for Treasury and Resources approves the transfer of £450,000 from a Transport and Technical Services revenue head of expenditure to capital.  

Reason for Decision

PG - The Housing MD says Housing will be recompensed all costs incurred by Housing from the Town park Project budget!!  Would this include the asset value in compensation as well? 

RF - JPH would not be expected to ‘buy’ the asset from Housing - I expect Housing are seeking recompense for the demolition cost.  Assets are normally transferred between departments at carrying value.
