Road Traffic (Public Parking Places) (Jersey) Order 2006: Amendment to include Elephant Park Car Park, St. Brelade

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Jersey Car Parks - Amendment to Road Traffic (Public Parking Places) (Jersey) Order 2006 to add the Elephant Park Car Park in St Brelade.

 

Decision(s): The Minister agreed to amend the Road Traffic (Public Parking Places) (Jersey) Order 2006 to add the Elephant Park Car Park, St. Brelade as a disc parking place with a maximum stay of 3 hours.

AMENDMENT TO ROAD TRAFFIC (PUBLIC PARKING PLACES) (JERSEY)

 

ORDER 2006 – INTRODUCTION OF ELEPHANT PARK CAR PARK WITH A

 

 MAXIMUM STAY PERIOD OF 3 HOURS DURING ANY ONE VISIT TO THE

 

PARKING PLACE

 

 

Purpose of the Report

 

To introduce The Elephant Park Car Park in St Brelade with a maximum stay period of 3 hours during any one visit to the parking place with a requirement for the arrival time to be displayed using a parking disc and a restriction on commercial vehicles over 15 foot in length.

 

 

Background

 

The Connétable of St Brelade has requested that The Elephant Park Car Park be included in the Road Traffic (Public Parking Places) (Jersey) Order 2006 with a maximum stay period of 3 hours during any one visit to the parking place with a requirement for the arrival time to be displayed using a parking disc and a restriction on commercial vehicles over 15 foot in length to enable policing of the area to take place.

 

The request to include this car park with a maximum stay period will help to deter long term parking and will enable users of the facility there to park. The area has been found to be abused with long term parking and large commercial vehicles parking there causing difficulties for other users of the car park when checked by St Brelade Parish Officials

 

 

Discussion

 

Officers would support the introduction of the Elephant Park Car Park with a maximum stay of 3 hours during any one visit to the parking place with a requirement for the arrival time to be displayed using a parking disc and a restriction on commercial vehicles over 15 foot in length using this area. The policing and enforcement of this would be carried out solely by the Parish of St Brelade.

 

 

Recommendations

 

The Minister is recommended to approve the request from the Connétable of St Brelade and to instruct Officers to instruct the Law Draftsman to prepare an Amendment to the Road Traffic (Public Parking Places) (Jersey) Order 2006 to incorporate this.
