JEC Sub-Station Leases - Approval of.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

  1. Approved the lease of the specified pieces of land at Clos Gosset, St Peter’s Arsenal, Clos du Val, Clos de Petit Felard, St Mary’s Court, Le Pre de Talbot, Maple Grove, Pine Court, Cherry Orchard Court and Wellington Park to the Jersey Electricity Company Limited for a period of 99 years for a total consideration of £8,217.00.

 

  1. Requested that the Minister for Treasury & Resources approve the transactions in accordance with Standing Order 168, seek the approval of the States for the transaction and authorise the Greffier and Attorney General to sign the necessary contracts on behalf of the Public.

REPORT TO THE HOUSING MINISTER

 

PROPOSED LEASES OF LAND TO THE JERSEY ELECTRICITY COMPANY TO ALLOW FOR THE UPGRADING OF MAINS ELECTRICITY SUPPLY ON A NUMBER OF SOCIAL HOUSING SITES

 

Purpose

 

To recommend to the Minister for Treasury & Resources that the public enter into a total of 10 lease agreements with the Jersey Electricity Company at:-

 

Clos Gosset

Clos du Val

Clos de Petit Felard

St Mary’s Court

Le Pre de Talbot

St Peters Arsenal

Maple Grove

Pine Court

Cherry Orchard Court

Wellington Park

 

Background

 

The Housing Department has embarked on a programme of heating replacements for a significant proportion of its social housing stock which will see, inter alia, all of the States owned social housing stock fossil fuel free by 2013. The chosen solution which is being supported in part by funding from the fiscal stimulus programme is to install a night storage based electric heating and hot water system in each home which will run off of the JEC’s Comfort Heating tariff.

 

However, the current supply of electricity to a number of sites is inadequate to cope with the increased demand necessitated by the switch of heating type.  It is proposed that a number of new JEC substations and distribution pillars will be constructed as set out below and shown on the attached plans.  In addition, the JEC will require way-leave agreements for the substations, distribution pillars and cable routes on some sites.  The location of the sub station, distribution pillar and route of the cables are shown on the respective site plans annexed to this report.  This will require the land on which each of the substations and pillars are to be built to be leased to the Jersey Electricity Company for a period of 99 years in return for the consideration set out below.  These arrangements are consistent with existing arrangements elsewhere and the standard lease form agreed between the JEC, Housing Department, Jersey Property Holdings and Law Officers’ Department in 2009. 

 

Clos Gosset

 

The lease of a certain piece of land situate in a grassed area to the East or thereabouts of a block of flats bearing the letter B and the numbers 63 to 70 Clos Gosset and having the UPRN 69382973 in the development known as “Clos Gosset”, forming the site of Sub-Station number 683 and appurtenances and identified for information purposes only on the extract of the Jersey Digital Map attached to this report at annex a hereto with the ownership, without offset, of the two boundary stones; Joining on all sides the property retained by the Public.  The proposed building to be erected on the Sub-Station Site is shown, for identification purposes only, on a certain plan bearing the Drawing Number 107-C24-1 Revision F dated the 10th May 2005 and attached hereto at annex a1.

Also at Clos Gosset, the lease of a small piece of land situate to the North-Eastern corner of the block of apartments bearing the number 92-95 “Le Clos Gosset”, forming the site of shielded pillar number 1036, the whole in conformity with a certain plan bearing the number 121-C24 dated 29th April 2010 and attached to this report at annex b; joining on all sides of the property retained by the Public.

Clos du Val

 

The lease of  a certain piece of land situate to the North-East of a certain bin store in the development known as “Clos du Val” (having the UPRN 69382463), forming the site of Sub-Station number 757 and appurtenances and identified for information purposes only on the extract of the Jersey Digital Map and attached hereto at annex c; with the ownership, without relief, of the two boundary stones of the East; Joining on all sides the property retained by the Public.

Clos de Petit Felard

 

The lease of a certain piece of land situate to the South-West of block 9 to 12 in the development known as “Le Clos de Petit Felard” (having the UPRN 69123339), forming the site of Sub-Station number 765 and appurtenances and identified for information purposes only on the extract of the Jersey Digital Map attached hereto at annex d; Joining on all sides the property retained by the Public.

St Mary’s Court

 

The lease of a small piece of land (the location of which is identified by a black X on the plan attached at annex e hereto) forming the site of shielded pillar number 1043 situate to the East of the vehicular entrance of St. Mary’s Court and to the West of the North-Western or thereabouts corner of block B (having the UPRN 69383015) in the development “St. Mary’s Court”; Joining on all sides the property forming part of the property retained by the Public.  The proposed kiosk to be erected on the Shielded Pillar Site is shown, for identification purposes only, on a certain plan bearing the Drawing Number 117-M24 Revision A dated the 30th November 2010 and attached to this report at annex f.

Le Pre de Talbot

 

The lease of a certain piece of land situate near the South-Western corner or thereabouts of the development known as “Le Pre de Talbot” to the West of the rear garden of the property bearing the number 24 “Le Pre de Talbot” (having the UPRN 69126937), forming the site of sub-station number 766 and appurtenances and identified for information purposes only on the extract of the Jersey Digital Map attached to this report at annex g; Joining on all sides the property retained by the Public.

 

The proposed building to be erected on the Sub-Station Site is shown, for identification purposes only, on a certain plan bearing the Drawing Number 78-P24 Revision B dated the 23rd April 2010 and attached to this report at annex h.

St Peters Arsenal

Maple Grove

 

The lease of a certain piece of land forming the site of sub-station 771, the whole in conformity with a certain plan bearing the number 79-P24 Revision B dated the 30th November 2010 and attached hereto at annex j to this report; Joining on all sides the property retained by the Public.

Consideration:   £990.00

 

Pine Court

 

The lease of a piece of land forming the site at Substation 772 and appurtenances with the ownership (without relief) of the boundary stones of the West, North and East, the whole in conformity with a certain plan bearing the number 64-G24 Revision A dated 30th November 2010 and attached to this report at annex k; Joining by the West, North and East to the Property retained by the Public and bordering by the South to the pavement and road forming part of the property retained by the Public.

Cherry Orchard Court

That the Minister:-
