Pesticides approved for use in Jersey

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Purpose of the Report

 

The Minister for the Environment (The Minister) is requested to approve all pesticides registered on the UK Pesticides Register Database for use in Jersey.

 

Background

The Pesticides (General Provisions) (Jersey) Order 1991, Article 4, enables the Minister to give either a provisional or full approval for the sale and use of pesticides in Jersey.

Discussion

 

Before any pesticide can be used, sold, supplied or stored, it must be authorised for use. In the UK, these authorisations are granted by the Chemical Regulations Directorate (CRD). In the absence of an equivalent body and resources in Jersey, the Minister has approved all products listed in the UK, Pesticides Register Database (which contains the Pesticide register of UK authorised Products) and includes the extensions of authorisation, adjuvants, commodity substances and basic substances.

The Minister may at any time review, revoke or suspend an approval; or amend the conditions of an approval. In addition the Minister may approve a pesticide which has been authorised for use elsewhere subject to the conditions of use.

 

This approach will allow anyone authorised to use pesticides to be able to ensure that they are only using those which are currently approved for use and to be able to identify those which have been withdrawn from use and take steps to dispose of them in the appropriate manner.

 

This MD replaces and updates a previous Agriculture and Fisheries Committee Decision made in August 2005. This decision listed approved products as contained in the then Pesticide Safety Directorate (PSD) or the Health and Safety Executive. This decision is outdated and required updating through the present Ministerial Decision.

 

 

Recommendation

 

The Minister approves all pesticides registered on the UK Pesticides Register Database for use in Jersey.
