Eastern Cycle Route: Construction of Second Section

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister approved the construction of the second section of the Eastern Cycle Route, by approved Contractors selected by competitive tenders.  Work on this section to be carried out during February, March and April 2011.

 

Reason(s) for Decision: To allow the commencement of work on site while complying with the code of financial directions.

 

Resource Implications:  The Department has tendered the work for this section which will be paid for from the funding procured by the Deputy of Grouville from the Car Park Trading Fund.

 

Action required:  Acting Senior Engineer to implement the construction of the second stage of the Eastern Cycle Route.

TRANSPORT AND TECHNICAL SERVICES

 

EASTERN CYCLE ROUTE CONSTRUCTION OF SECOND SECTION

 

 

Purpose of the Report

 

For the Minister to approve the construction of the second section of the Eastern Cycle route.

 

 

Background

 

The Deputy of Grouville brought a successful amendment to the 2010 States of Jersey Business Plan to have £500,000 transferred from the Car Park Trading Fund to a Capital Fund to construct a cycle route from Gorey Pier to Grouville Primary School.  Providing infrastructure to encourage walking and cycling is a clear objective in the States of Jersey Strategic Plan, 2009 to 2014, confirmed by the approval of the Sustainable Transport Policy in December 2010.

 

 

Discussion

 

Following on from the first section approved under MD-T-2010-0076, the Department has been working on the design of, and approvals required for, the next section of the Eastern Cycle route. This second section will follow the northern edge of La Rue á Don from La Rue Horman to a point opposite the former Lavender Villa Hotel (see attached sketch).

 

The Department has worked on these plans with the Deputy of Grouville as well as the Eastern Cycle Way Advisory Group, a group formed by the Deputy from members of the Grouville community to help with design and consultation.

 

The Chef Tenants Du Fief de la Reine, Grouville (Tenants) have been fully involved with the design and routing of the work.  The Receiver General, who represents the interests of the Queen on Jersey with regard to Crown land, has also been consulted on the proposals.  The Connétable and Roads Committee of Grouville have also been consulted.

 

A Planning Application for this section has been approved by the Planning Applications Panel.

 

 

Conclusion

 

Following extensive consultation and a number of design iterations to take account of feedback received the Department has secured Planning Approval for the second section of the Eastern Cycle Route as shown on the attached sketch.

 

 

 

 

Recommendation

 

The Minister is recommended to approve the construction of the second section of the Eastern Cycle Route, by an approved Contractor or Contractors selected by competitive tender.

 

Reason(s) for Decision

 

To allow the commencement of work on site while complying with the code of financial directions.

 

 

Resource Implications

 

This section of the work will be paid for from the funding procured by the Deputy of Grouville from the Car Park Trading Fund, and be carried out by an approved Contractor selected by competitive tender.  TTS do not have resources available to carry out the work during the first half of 2011.
