Road Traffic (St Helier) (Jersey) Order 1996 and Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2005.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):   The Minister agreed:

1. To introduce additional motorcycle parking spaces in the town area.

2. To make permanent six temporary Orders under Article 68 of the Road Traffic (Jersey) Order 1956

3. To introduce additional requests from the Parish, and Transport and Technical Services.

4. To make adjustments to the existing Residents Parking Zones.

Reason(s) for Decision: At the request of the Connétable and Transport and Technical Services, to amend the Road Traffic (St Helier) (Jersey) Order 1996 and Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2005.

Resource Implications: Law drafting time, Transport and Technical Services Department’s time.

Action required:   Officers to proceed jointly with the Parish with public consultation and if no objections are received, to instruct the Law Draftsman to prepare an Amendment to the Orders for subsequent submission to the Minister.

TRANSPORT AND TECHNICAL SERVICES

 

ROAD TRAFFIC (ST HELIER) (JERSEY) ORDER 1996 AND ROAD TRAFFIC (DISABLED PERSONS) (PARKING) (JERSEY) ORDER 2005

 

 

Purpose of the Report

 

To amend the Road Traffic (St Helier) (Jersey) Order 1996 and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2005

  

Background

 

1. Proposed additional motorcycle parking

 

The Parish and Transport and Technical Services have requested to increase the number of on-street motorcycle parking spaces in various locations in the town centre.

 

 2. Temporary Orders

 

Since the last Amendment five Temporary Orders were made by the Minister for Transport and Technical Services, and two by the Connétable of St Helier, under Article 68 of the Road Traffic (Jersey) Law 1956, for a period not exceeding twelve months. It is requested by the Parish, and Transport and Technical Services that these temporary orders (with the exception of the Hilgrove Street Order, which is the subject of a subsequent temporary Order) be made permanent, and included in Road Traffic (St Helier) (Jersey) Order 1996, and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2005.

 

3. Additional requests

 

The Parish and Transport and Technical Services have submitted additional requests to be included in the Road Traffic (St Helier) (Jersey) Order 1996.

 

4. Residents’ Parking Zones

 

The Parish has requested changes to the parking restrictions in the three Residents’ Parking zones.

  

Discussion

 

1. Proposed additional motorcycle parking

 

During the past two years the Parish of St Helier has received several requests to increase the number of on-street motorcycle parking spaces in the Town Centre. As it is estimated that four or five motorcycles can be accommodated in the space required by one car, it is considered that providing more motorcycle parking would be a more sustainable use of on-street parking facilities. The Parish estimate that whereas over the last two years bicycle parking provision has been increased by approximately 150 spaces, motorcycle parking provision has increased by less than half this number. The Parish, together with Transport and Technical Services, has therefore identified a number of town centre locations where 64 additional on-street motorcycle parking spaces could be provided.  Motorcyclists are claiming that the current facilities are inadequate, which is borne out by surveys showing that the current spaces are frequently fully occupied.

 

The streets affected by the requested additional motorcycle parking spaces are as follows:-

 

  1. Gloucester Street
  2. Seale Street
  3. Patriotic Street.
  4. Nelson Street
  5. Commercial Street
  6. Grenville Street

 

In addition, the Parish has suggested that motorcycle parking should be provided in the south west corner of Commercial Buildings. Approximately ten motorcycles could be parked here, in a designated space, as indicated on the attached plan No.1.

 

2. Temporary Orders

 

The items relating to the Road Traffic (St Helier) (Jersey) Order 1996 and Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2005 and currently subject to temporary orders made under Article 68 of the Road Traffic (Jersey) Law 1956, for a period not exceeding twelve months, are as follows:-

 

Parish requests

 

09 July 2007   Windsor Road  Plan No 2

 

This Temporary Order was made as a result of the Parish assessment of roads regarding possible on-street parking locations. During recent resurfacing of the road it was found that there was capacity to create five additional 2 hour disc parking spaces.

 

 Transport and Technical Services requests

 

01 May 2008   St Johns Road  Plan No 3

 

This Temporary Order was made to remove the 13 parking spaces on the east side of St Johns Road, in front of Clubley Estate, as a result of the construction of a pedestrian refuge to facilitate the new housing development entrance on the west side.

  
 

28 August 2007  Esplanade   Plan No 4

 

This Temporary Order was made to facilitate the updating of parking facilities on the Esplanade in advance of the opening of the new Transportation Centre.

 

The removal of all existing parking restrictions on the north side of the Esplanade between Castle Street and Conway Street, to facilitate the new road and footpath layout and install revised on-street parking facilities, as follows:-

 

  1.  Two 11 yard sections of parking for motorcycles and mopeds,
  2.  One 34 yard section of 1 hour pay card parking,
  3.  One 10 yard and one 12 yard section of parking for loading and unloading.
  4.  One 12 yard section of parking for vehicles used by disabled persons. It is now proposed to change this section of parking to loading and unloading, following a request from the Department’s Parking Control Section for an unloading facility for toilet cleaners’ vehicles and delivery vehicles servicing Liberation Station. 

 

08 October 2007  Mont Cochon   Plan No 5

 

This Temporary Order was made to allow 37 yards of 1 hour pay card parking on the west side of Mont Cochon between La Route de St Aubin and St Andrews Road at the time of the traffic calming improvement scheme.

 

18 February 2008  Rouge Bouillon

 

This Temporary Order was made to remove the no left-hand turn restriction from Upper Midvale Road into Rouge Bouillon, and the no right-hand turn restriction from Midvale Road into Rouge Bouillon.

 

Due to complaints and subsequent surveys showing that motorists turn illegally into Rouge Bouillon from Midvale Road and Upper Midvale Road and, therefore, pose a danger to pedestrians using the pedestrian crossing at this junction, it was decided to substitute these restrictions with an all red phase of the traffic signals when the pedestrian crossing is activated.

 

22 August 2008  Weighbridge Place    Plan No 6  

2 hour limit 

 

This Temporary Order was made to provide disabled persons parking spaces in Weighbridge Place, to replace the disabled persons parking space lost due to the redevelopment of Caledonia Place and the spaces on the Esplanade to be changed to loading and unloading.

 

 

3. Additional requests

 

Parish requests

 

1. Hue Street    Plan No 7  

The Parish has requested that the time limit of the disabled parking bay adjacent to the Magistrates Court be reduced from four hours to two hours.

 

This request is considered necessary to make more effective use of the facility at this location.

 

2. Great Union Street  Plan No 8  

It is proposed that the current one hour pay card parking spaces be changed to two hour disabled persons parking spaces.

 

The Royal British Legion situated in Great Union Street has requested that disabled persons parking facilities be provided for its elderly members to attend meetings.

 

3.  Kensington Place     

The Parish has requested that the time limit of the unloading bay at the northern end of Kensington Place be reduced from one hour to 20 minutes.

 

This request has been made so that this unloading bays’ time limit is in line with other unloading bays in the area.

 

4. Residents’ Parking Zones  

The Parish has requested changes to the parking restrictions in its three Residents’ Parking Zones. The changes are detailed in a letter to Transport and Technical Services Car Parks Manager, dated 08 August 2008. Parking in these zones is currently policed by Parish Officers.

  

Transport and Technical Services requests

 

1. The Parish together with the Department’s Parking Control Section has requested that provision be made in the Road Traffic (St Helier) (Jersey) Order 1996 to prohibit motorists from returning to a pay card, disc parking space, or disabled persons parking bay within one hour of leaving that parking space.

 

This request is to discourage motorists from using the spaces beyond their allotted time, thereby denying others the opportunity to park.

 

2. Commercial Buildings   Plan No 9  

Create 16 yards of parking of vehicles for loading and unloading, and reduce the number of existing one hour pay card parking spaces by 11 yards at the southern end of Commercial Buildings. The times of loading and unloading to be 20 minutes between 5.00 a.m. to 6.00 p.m.

 

This request is to allow business premises at this end of Commercial Buildings to legally load and unload their goods.   

 

3. Caledonia Place Due to the redevelopment of  Caledonia Place following the relocation of the bus station, it is necessary to request the Law Draftsman to remove the items relating to the current one hour pay card parking spaces and the disabled persons parking space from the above Orders. This road will also be closed to through traffic.

 

4. Robin Hood    Plan No 10  

It is requested that a “stopping of vehicles at certain road junctions” restriction (yellow box), be installed at the Robin Hood junction to allow traffic exiting Trinity Road to enter the lane to the gyratory system.

 

5. Union Street    Plan No 11  

It is requested that a “stopping of vehicles at certain road junctions” restriction (yellow box), be installed at the Union Street, Parade (eastern arm) junction, to prevent motorists travelling east from blocking traffic travelling west and entering the Parade (eastern arm). A keep clear advisory marking is currently present at this location.

 

6. Hill Street     Plan No 12  

Following consultation with the Parish it is requested that a section of 56 yards of one hour pay card parking be established on the north side of Hill Street, east from its junction with Halkett Place. This section of Hill Street is currently subject to prohibition of waiting.

 

This request has become feasible following a decision by the Parish not to proceed with the final phase of the town cycle network, which would have featured a contraflow route eastbound along Hill Street.

  

Recommendation

 

The Minister is recommended to approve all of the requests.
