Transport and Technical Services - 2009 Increases to Fees and Charges.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister approved the increases to the Department’s fees and charges relating to clinical waste disposal.

Reason(s) for Decision:  To enable Transport and Technical Services to increase its fees and charges relating to clinical waste disposal over and above the recommended 2.5% so that over a period of time it can maintain current cost recovery levels.  The Treasurer of the States, acting under Delegated Authority, has already endorsed this proposal.

TRANSPORT AND TECHNICAL SERVICES  

2009 INCREASES TO FEES AND CHARGES FOR CLINICAL WASTE  

Purpose of the Report  

The Minister for Transport and Technical Services is asked to approve a request to increase the Department’s revised fees and charges for clinical waste disposal. 

Discussion  

     The former Minister for Transport and Technical Services signed decision number MD-T-2008-0104 on 6th November 2008, approving a 34% increase to the clinical waste disposal fees to ensure full cost recovery of clinical waste disposal.  This followed an internal audit review undertaken in 2007 on the effectiveness and controls in relation to the costing of the disposal of clinical waste.  It concluded that “the recharge for clinical waste disposal should be based on a current year costing and the basis of the charge should be revisited to establish the ‘real cost’ of disposal on a per kg basis”.  The charge of 98p per kilo (excluding GST) originally proposed for 2009 has been based on 2007 actual as the 2008 basis, which is budget forecast, can fluctuate.  However, following discussions with Officers from the Treasury and Resources and Health and Social Services Departments it was agreed that this increase would be too onerous on Health’s 2009 budget, and that the increase should be phased in over a period of time at 8% per annum.  The Treasurer under delegated authority signed a Treasurer’s decision on the 5th February agreeing to the increase of 8% per annum.  Therefore the proposed charge for clinical waste disposal per kilo is 79p, a total of 81p per kilo including GST. 

Recommendations  

The Minister is recommended to approve the revised increase to the Department’s fees and charges for clinical waste disposal to come into affect on 1st March 2009.
