LOGOS II - publication of report

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

A decision  made (21.01.08) to agree to the publication by the Marine Accident Investigation Branch (MAIB) of the LOGOS II report.

Shipping Law - Accidents

 

Decision(s):

The Minister has agreed that the Marine Accident Investigation Branch (MAIB) can proceed with publication of the LOGOS II Report concerning the incidents of 20 and 26 June 2007.

 

Reason(s) for Decision:

The MAIB has conducted an investigation on behalf of the Minister concerning the LOGOS II. The associated report is due to be published shortly.

 

Article 166 (6) of the Shipping (Jersey) Law 2002 states “If the report indicates that there was or may have been a breach of the law and that as a consequence a prosecution should be considered, the Minister shall not publish the report until 

(a)     if it is decided to prosecute, the prosecution, including any appeal, has been concluded; or

(b)     it is decided not to prosecute.”

 

The Minister therefore may not publish a report (a) if it is decided to prosecute, until that has been concluded or (b) it is decided not to prosecute.

 

Article 12 of the Pilotage (Jersey) Law 1988 states “If the pilot of a ship 

(a)     does any act which causes or is likely to cause the loss or destruction of, or serious damage to, the ship or its machinery, navigational equipment or safety equipment, or the death of, or serious injury to, a person on board the ship; or

(b)     omits to do anything required to preserve the ship or its machinery, navigational equipment or safety equipment from loss, destruction or serious damage or to preserve any person on board the ship from death or serious injury,

 

and the act or omission is deliberate or amounts to a breach or neglect of duty or the pilot is under the influence of drink or a drug at the time of the act or omission, the pilot shall be guilty of an offence, and in addition to any liability for damages shall be liable to a fine or to imprisonment for a term not exceeding 2 years, or to both.”

 

Whilst no police investigation has taken place, the Attorney General has reviewed the draft Report and confirmed that he is not minded to take any criminal proceedings on the information currently available to him.

 

 

Resource Implications:

There are no new financial, ITC, property or human resources issues arising.

 

Action required:

Following the Ministerial Decision, the MAIB will be informed that publication may proceed.
