Notice of Intention to List as Site of Special Interest: 11 Commercial Buildings, St Helier.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister for Planning and Environment;

  1. confirmed the intention to List 11 Commercial Buildings, St Helier, as defined in the attached schedule, as a Site of Special Interest under the provisions of Article 51(2)(b) Planning and Building (Jersey) Law 2002 by virtue of its special architectural and historical interest as described in the same schedule, and;

2. approved the serving of the Intention to List Notice in accord with the requirements of the Law.

Reason(s) for decision:

  1. The special interest of 11 Commercial Buildings, St Helier, as defined and assessed relative to the published criteria for selection, justifies its inclusion on the List of Sites of Special Interest in accordance with the provisions and purposes of the Planning and Building (Jersey) Law 2002.
  2. The proposal accords with the States Strategic Plan commitment of protecting and sympathetically managing our built heritage assets.

Action required:

  1. The Intention to List Notice to be served in accord with the requirements of the law;
  2. No sooner than 28 days after the date of service of the Intention to List Notice, a further report will be brought back to the Minister relative to any representations received.

Purpose of the Report

The purpose of this report is for the Minister to consider a proposal to include 11 Commercial Buildings, St Helier on the List of Sites of Special Interest under the Planning and Building (Jersey) Law 2002 and to authorise the serving of a Notice of Intention to this effect.

Background and Discussion

Numbers 10,11,12,13,19,21,22,23,24,26,27 & 29-31 Commercial Buildings were the subject of an appeal against Registration as proposed Sites of Special Interest which was considered by the Minister on 9th November 2006. The report put forward at that time, compiled by the Curator of Historic Buildings, considered the information available from both the Appellant and MRLAG and its predecessor, and recommended in the case of this site that it should be retained as a proposed Site of Special Interest, though the warehouse to the rear should be removed from the Register. The Minister accepted this recommendation.

Now that the appeal has been determined, the process continues towards full designation as an SSI extending its protection under law rather than simply policy.

Recommendation

On the basis of the above, the Minister for Planning and Environment is recommended to;

  1. confirm the intention to List 11 Commercial Buildings, St Helier, as defined in the attached schedule, as a Site of Special Interest under the provisions of Article 51(2)(b) Planning and Building (Jersey) Law 2002 by virtue of it’s special architectural and historical interest as described in the same schedule, and;
  1. approve the serving of the Intention to List Notice in accord with the requirements of the Law.
