Transfer of States Building Project to Property Holdings.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

TRANSFER OF BALANCE OF STATES BUILDING REFURBISHMENT CAPITAL VOTE

Decision(s): The Minister approved the transfer of the current budget and net expenditure contained in the States Building Refurbishment capital vote C2626 from Transport and Technical Services to the Property Holdings Department.

Reason(s) for Decision:  Property related capital projects of this type are now managed by Property Holdings, a department which was created by the States in 2005 to manage and develop property on behalf of the States.

  1. Purpose of Report
  2. The Minister is asked to agree to the transfer of the current budget and net expenditure contained in the Head of Expenditure C2626 QZB004 ‘States Building Refurbishment' from Transport and Technical Services to the Jersey Property Holdings company (01760).

 

  1. Background
  2. Since Property Holdings was created in January 2006, it has gradually taken on responsibility for capital schemes relating to the development and improvement of property.
  3. The States Building Refurbishment project C2626 is almost complete apart from some additional small works on air conditioning and drains.
  4. The budget situation is currently-:

Budget      £8,314,700

Expenditure     £8,166,107

Net unspent available for transfer     £148,593 

  1. Recommendations
  2. That the Minister approves the transfer of the current budget and net expenditure currently held in QZB004, C2626 States Building Refurbishment from Transport and Technical Services(Company 03600) to the Property Holdings Department (Company 10760)
  3. Reason for Decision
  4. To transfer a property related capital project to Property Holdings which is the Department set up to manage projects of this type.
