Dentistry (Jersey) Law 2015: Registration Fees: Approval Request from Minister for Treasury and Resources

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Dentistry (Jersey) Law 2015 - registration fees determined by the Minister.

Decision(s): The HSSD Minister decided, in accordance Financial Directions 4.1, to request the Minister for Treasury and Resources to approve the proposed registration fees to be charged  under the new Dentistry (Jersey) Law 2015  

 

Reason(s) for Decision: 

   

The Dentistry (Jersey) Law 2015 provides for the registration of dental care professionals aligning Jersey Law with equivalent profession registration with the General Dental Council in the UK.  Under the Law, as well as dentists, six additional of classes of dental care professionals are permitted to practise dentistry.

 

The costs associated with implementing the new regulatory regime will be met through applying a registration fee in accordance with the States decision in relation to P89/2015.  

 

The proposed registration fee, which is payable annually is £55.  This is calculated on a cost recovery basis and in accordance with Financial Directions 4.1 the income will not exceed the cost of service provision.

 

Resource Implications: The income raised from fees will contribute to the costs of administering the registration process

TITLE:   Dentistry (Jersey) Law 2015 – Proposed Registration Fees

  1. Background

 

The Dentistry (Jersey) Law 2015 was adopted by the States on 22 September 2015, Sanctioned by Order of Her Majesty in Council on 9 December 2015 and Registered by the Royal Court on 18 December 2015.  

 

The new Law will require the classes of Dental Care Professionals currently regulated by the General Dental Council in the UK, to be registered in Jersey these are:

  • Clincial Dental Technician
  • Dental Hygienist
  • Dental Nurse
  • Dental Technician
  • Dental Therapist
  • Orthodontic Therapist

The Dentistry (Jersey) Law 2015 was approved by the States in September and registered in the Royal court on 18 December 2015. Under the new Law, a dental care professional’s registration expires on 31 December and must be renewed annually.  Under Article 8 of the Law there is provision for the Minister to ‘determine’ a fee to be charged and accompany the application for registration or renewal of registration.  The registration fee is intendended to cover the cost of implementation of the new Law as set out in P.89/2015 and the report accompanying the Draft Law.

 

  1. Proposed Fee

 

The HSSD Minister has therefore determined that, subject to approval from the Treasury and Resources Minister, the registration fee should be set at £55.00.  This charge was calculated on the full cost per registration based on direct and indirect staffing, online registration database licence, server and  support fees, as well as direct and indirect overhead costs.

  1. Proportionality of fees

 

The registration fee will offset the costs associated with regulation that otherwise would be borne by the taxpayer.  The proposed fee is fair and equates to approximately £1.06 per week per practitioner.  Charges for an appointment with a dental hygienst vary between £59 - £95.00 per visit.
