A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister agreed to a budget transfer of £150,000 in 2007 from the Housing Department to the Social Security Department. The budget for 2008 is included as part of the Annual Business Plan for 2008.
Reason(s) for decision The subsidies team physically transferred to the Social Security Department at the beginning of 2007 in order to aid the transition to Income Support. To facilitate the operational management of this team the budget for administration should also transfer to Social Security. It is proposed that £150,000 is transferred in 2007 reflecting the budget for this team from the 1st July to 31st December 2007. As such complete responsibility for this team will reside with Social Security from 1st July although responsibility for the schemes administered will remain with the Housing Department.

REPORT TO THE MINISTER FOR SOCIAL SECURITY

Budget Transfer from Housing

Purpose of the Report

To request the approval for the transfer of the Housing Subsidies Administrative budget from the Housing Department to the Social Security Department from 1st July 2007. The transfer of this budget will facilitate the transition to Income Support.

Background

To enable a smooth transition to income support the Subsidies team physically transferred to the Social Security Department in January 2007. At the current point in time the budget for this team remains within Housing. This is not operationally effective as management decisions and budget responsibility should reside in the same area. The details of how the budgets have been calculated are shown below:

In respect of 2007 this relates to the period 1st July to 31st December 2007

In respect of 2008 this has already been reflected in the Housing and Social Security Business Plans for that year.

Recommendation

The Minister is recommended to approve the transfer of £150,000 in 2007 to Social Security reflecting the budget for the Subsidies team from 1st July to 31st December 2007.
