Appointment of Experts under the Loi (1860) sur le Transfert d’Héritages
(Public)
Purpose of the Report
It is proposed that the Chief Minister appoint nominated individuals to serve as Parish Experts under the Loi (1860) sur le Transfert d’Héritages. The appointed Experts will be requested to attend a session of the Royal Court to take the Oath of Office at the earliest opportunity.
Background
Prior to the introduction of Ministerial Government in December 2005, the Loi (1860) sur le Transfert d’Héritages was administered by the Legislation Committee. Under Article 2 of this law the Committee was required, every five years, to appoint 24 Experts – 12 Experts from the Parish of St. Helier and 12 experts from the other 11 parishes.
The rôle of the Experts is to determine the value of property in the Parishes of the Island in cases where they may be a dispute. According to a note prepared by Advocate S. Pallot in 2003 (attached), “whilst experts are unlikely to be used often in practice, the office is still relevant.”
As part of the move to Ministerial Government a number of matters of committee business were transferred to relevant Ministerial Departments. The Chief Minister’s Department assumed responsibility for the administration of the Loi (1860) sur le Transfert d’Héritages. The term of office for the 24 serving Experts expires on 31 December 2007 and it is now necessary to ensure that experts are appointed for the next period of five years.
Discussion
The procedure followed in the past was that the Legislation Committee wrote to each of the 12 Parish Connétables seeking nominations for this position. Once the nominations were received the Committee formally made the nominations. The Law now requires the Chief Minister to make these nominations and, on the advice of the Connétables, appropriate individuals have been put forward for nomination.
Resource Implications
As this is a procedural matter it is expected that there will be no resource implications other than the already allocated Royal Court time for the experts’ swearing in.
Recommendation
That the Chief Minister approves the nomination of the following experts to be sworn in at Royal Court and serve as Experts under the Loi (1860) sur le Transfert d’Héritages:
