Fish Farm Concession: Renewal

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

 

The Minister approved the renewal, and agreed that the fish farm concession authorisation should specify the species farmed, which are; the European Flat Oysters (Ostrea edulis), in addition to the historically farmed species of Pacific Oysters (Crassostrea gigas), Ormers (Haliotis tuberculata) and Manila Clams (Venerupis philippinarum (and synonyms)).

 

Reason(s) for Decision:

 

The Minister is responsible for the issue of fish farming licences on the seabed under the Sea Fisheries (Fisheries) (Jersey) Regulations 2010 and for the renewal of licences under the Sea Fisheries (Jersey) Law 1994 .

 

The new Sea Fisheries (Fisheries) (Jersey) Regulations 2010, repeals the previous Sea Fisheries (Establishment and Regulation of Fisheries) (Jersey) Regulations 1998, under which the licence holder currently holds an Act of Authorisation, due to expire on the 16th of December 2010. Under article 10 of the Sea Fisheries (Fisheries) (Jersey) Regulations 2010, the Act of Authorisation will, upon expiration, have to be renewed in compliance with the Sea Fisheries (Fisheries) (Jersey) Regulations 2010. Under article 5 of the Sea Fisheries (Fisheries) (Jersey) Regulations 2010, the renewed Act of Authorisation will have to specify the kind and species of fish to which the fishery relates.

 

As such, the concession holder has requested a renewal which requires the Act of Authorisation to allow specifically for the farming of European Flat Oysters (Ostrea edulis). This decision carries with it an increased cost in sampling for a species, which is not currently grown on any other concession areas. However it is intended to defray this cost to the applicant.

 

Resource Implications:

 

Increased costs in sampling European Flat Oysters (Ostrea edulis) by Officers will be recovered from the applicant as specified in the licence conditions attached to the Act of Authorisation.

Renewal and Change in Fish Farm Authorisation

 

 

Purpose of the Report

 

The Minister is responsible for the issue of fish farming licences on the seabed under the Sea Fisheries (Fisheries) (Jersey) Regulations 2010 and the Sea Fisheries (Jersey) Law 1994. This written report summarises the considerations surrounding the application for the renewal of a fish farming concession by Mr A. N. Legg.

 

Background

 

On the 16th of December 2010, the Act of Authorisation for Mr A. N. Legg’s fish farming concession is due to expire. Mr. Legg’s previous Act of Authorisation covered ‘Oysters’. Mr Legg previously farmed the Pacific Oyster (Crassostrea gigas), and has applied for a renewal of this concession with the addition of the European Flat Oyster (Ostrea edulis). Mr Legg has held this concession since 1998, and this will be his second renewal. Historically, Mr Legg has farmed Pacific Oysters (Crassostrea gigas), Ormers (Haliotis tuberculata) and Manila Clams (Venerupis philippinarum (and synonyms)) on this concession. The European Flat Oysters is still an oyster but it does present a new addition.

Discussion

 

European Flat Oysters (Ostrea edulis) are an additional species to those historically farmed by Mr A. N. Legg. The addition of this species will present increased costs to the States Of Jersey departments involved in administering, regulating, monitoring and testing O. edulis. However, under both current and previous licence conditions, and in accordance with the Sea Fisheries (Jersey) Law 1994 and the Sea Fisheries (Fisheries) (Jersey) Regulations 2010, the Minister may make provision to reclaim any costs incurred.

 

Mr. Legg intends to grow O. edulis in order to “diversify” his company and the stock on his concession area. This is in response to the recent, industry-wide, high mortality of Pacific Oysters (Crassostrea gigas) caused by the emergent Oyster Herpes virus.

Recommendation

 

The Minister is asked to renew the Act of Authorisation for Mr. A. N. Legg and to include the European Flat Oysters (Ostrea edulis) as an authorised species, in addition to the historically farmed Pacific Oysters (Crassostrea gigas), Ormers (Haliotis tuberculata) and Manila Clam (Venerupis philippinarum (and synonyms)).
