Bus Shelters: 7 Installations at various Island locations

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: To approve the installation of seven new bus shelters in support of the States of Jersey Strategic Plan and the Sustainable Transport Policy.

 

Decision(s): The Minister approved the installation of seven bus shelters at the following bus stop locations: Red Houses Shops S, Clos Orange N, The Limes, Rose Farm E, La Hougue Avenue S, Hameau de la Mer W and Airport Garages N.

 

Reason(s) for Decision: To provide bus shelters at suitable locations to improve facilities for bus users, in accordance with the States of Jersey Strategic Plan and the Sustainable Transport Policy.

 

Resource Implications: The shelters can be funded from the 2015 Sustainable Transport Fund allocated for the purpose of providing bus shelters as well as other Planning related sources.

 

Action required: Senior Engineer to arrange for the shelters to be procured and erected.

THE PROVISION OF NEW BUS SHELTERS

 

 

Purpose of the Report

 

To approve the installation of seven new bus shelters in support of the States of Jersey Strategic Plan and the Sustainable Transport Policy.

 

 

Background

 

The States of Jersey Sustainable Transport Policy sets a goal of improving bus usage by 100% by 2015.  In addition to improvements to bus schedules and services, the on street facilities for bus users will need to be improved.  Bus shelters can make life considerably better for bus users and the Department has frequent requests for such improvements.

 

 

Discussion

 

The Department has identified seven locations where bus shelters can be installed. Using the bus stop naming convention these sites are:

 

  1. Red Houses Shops S
  2. Clos Orange N
  3. The Limes
  4. Rose Farm E
  5. La Hougue Avenue S
  6. Hameau de la Mer W
  7. Airport Garages N

 

The first bus shelter on the list above will be located on land belonging to the Channel Islands Co-Operative Society who will be contributing to the cost of the shelter from their Sustainable Fund.  The remainder will be located on land already in Public ownership.  Hameau de la Mer W and Airport Garages N have been funded by nearby developments (Hameau de la Mer Housing Development and the Airport Cargo Centre) and are a requirement of the Planning Permits for those developments.

 

For the remainder, the erection of bus shelters has been deemed to be permitted development by the Planning Department, which means the Minister for Transport and Technical Services can install the shelters in accordance with the Planning and Building (General Development) (Jersey) Order 2011. The Department has therefore not had to make a planning application.

 

However, to ensure that the public are aware of the proposals, a drawing similar to those which would have been required for a planning application has been prepared and placed on the States of Jersey website consultation pages. Site notices were erected at the sites and the public invited to comment over a three week period. No responses were received objecting to the proposals but ten responses were received, all of which were supportive. It should be noted that the consultation also elicited a number of requests for bus shelters at other locations. These have been noted by the Department for future prioritisation of resources as well as assessment for practicality of installation.

 

Recommendation

 

The Minister is recommended to approve the installation of the seven bus shelters as listed:

 

1. Red Houses Shops S

2. Clos Orange N

3. The Limes

4. Rose Farm E

5. La Hougue Avenue S

6. Hameau de la Mer W

7. Airport Garages N
