Amendments to the Road Traffic (St. Lawrence) (Jersey) Order re: prohibition of waiting in areas of Le Mont Cambrai and La Route de St. Aubin.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

TRANSPORT AND TECHNICAL SERVICES

ROAD TRAFFIC (ST LAWRENCE) ( JERSEY ) ORDER 1990 –

AMENDMENT No. 19

Purpose of the Report

To prohibit waiting on two sections of Le Mont Cambrai to improve road safety, and to reduce two small sections of parking space on La Route de St Aubin to allow for the construction of two pedestrian refuges.

Background

On the 10th February 2006 the Minister for Transport and Technical Services approved the above Parish requests with regard to the prohibiting waiting on two sections of Le Mont Cambrai, and reducing two small sections of parking on La Route de St Aubin, and instruct the Law Draftsman to draft the necessary Order Amendment.

The Environment and Public Services Committee had previously approved the reduction of two small sections of parking on La Route de St Aubin, temporarily, for a period not exceeding twelve months under Article 68 of the Road Traffic (Jersey) Law 1956, and it is now necessary to make this permanent and include it in the Road Traffic (St Lawrence) (Jersey) Order 1990.

Discussion

The Minister is requested to approve the attached Draft Road Traffic (St Lawrence) (Amendment No.19) (Jersey) Order 2006, with regard to the above items, to be included in the Road Traffic (St Lawrence) (Jersey) Order 1990.

Recommendation

The Minister is requested to approve the Amendment to be effective from the 18th April 2006.

Reason (s) for Decision

To prohibit waiting on sections of Le Mont Cambrai, and reduce two sections of parking on La Route de St Aubin.

Action Required

The Minister to instruct his officers to advise the Greffier that the Order has been made.
