Plat Douet School and Trinity School: Extensions: Drawings Approval

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Additional Primary School Capacity Projects - Approval of Drawings to extend Plat Douet and Trinity Schools.

Decision(s):

 

a)        In accordance with paragraph (1) (d) of Standing Order 168, the Assistant Minister, under delegated authority, approved drawings numbered/ref: 10482/11, 10482/12, 10482/13 and 10482/15 all showing the proposed extension to Plat Douet School and drawings numbered/ref: 10487/54, 10487/52, 10487/53, 10487/56, 10487/55 10487/50 and 10487/51 all showing the proposed extension to Trinity Douet School.

 

b)        The Assistant Minister agreed that under delegated powers (approved by the Minister for Treasury and Resources on the 15 March 2012), the Director of Property Holdings can accept work packages and award appropriate JCT Building Contracts.

 

Reason(s) for Decision:  

 

  1. The drawings noted in item (a) above have been granted planning approval (Permit Nos: Plat Douet School P/2014/0180 and Trinity School P/2015/0649 refer) and reflect the use for which the funding is provided.

 

  1. Under Standing Order 168 (1) (d), it is a requirement for the Minister for Treasury and Resources to approve plans for the construction (or alteration) of buildings where the work is to be funded wholly or partly by money voted by the States.

 

  1. The estimated total cost for the abovementioned works (including the current estimated build costs, professional fees and ‘other’ costs), as designed, can be completed within the allocated budget.

 

  1. The JPH Director of Estates is to sign the contract and any other associated documentation.
