Renewal of Employment Forum Member.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

To approve a second three year term on the Employment Forum for Mrs Sally Johnson, an existing Employment Forum member.

Reason(s) for decision:

Mrs Johnson’s first three year term on the Employment Forum ends in September 2006 and she would like to sit on the Forum for a second three year term. The Forum Chair and members would welcome such an extension to her appointment.

Action required:

The Minister to approve the renewed term of appointment and confirm this in writing to Mrs Johnson. It is not necessary to inform the States of the renewal.

Renewal of Employment Forum Member.

Employment Forum Membership

The Minister is asked to approve the extension of the term of office for an existing member of the Employment Forum.

Mrs Sally Johnson’s term, as an ‘independent’ member of the Forum, expires at the end of September 2006, and she wishes to extend her appointment for a second three year term.

The Forum is intended to consist of nine members, appointed on the basis of their interest in employment relations and diversity of backgrounds, with three employer, three employee and three independent representatives. The Employment Law requires that members are appointed by the Minister.

The Forum would welcome Mrs Johnson continuing on the Forum because she has proved to be willing and committed, independent member of the group. This additional term will also provide continuity within the Forum, given that three new members were appointed in January this year.

The Minister is asked to approve the extension of Mrs Johnson’s term of office on the Employment Forum, to the end of September 2009.
