P.31/2010 Health and Social Services Department - Management Improvement Plan - comment by the Minister for Health and Social Services

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

PROPOSITION  
 

THE STATES are asked to decide whether they are of opinion –  

 To request the Minister for Health and Social Services to prepare and present to the Assembly for information within 6 months of the date on which the recently appointed Chief Executive takes up her post – 

(a) a Management Improvement Plan for the Health and Social Services Department which, inter alia, provides a structure, and leads to a culture, which underpins implementation of the recommendations of the Verita Report; and 

(b) plans for the introduction of strengthened and credible whistle-blowing procedures and patient complaint procedures.

Comment  

I have pleasure in accepting both parts of this proposition. 

With regards to part A, I will seek to bring forward a Management Improvement Plan for Health and Social Services which identifies a structure that facilitates the implementation of both the Verita and Williamson recommendations and provides a more appropriate separation of the operational delivery of services from the strategic aspects of Health and Social Services.  I am keen for my new Chief Officer to bring this forward in her first 6 months in office.  I am happy to bring this plan to the Assembly for information. 

With regards to part B, the States wide whistle-blowing policy is administered by the Chief Minister’s Department. The current policy was introduced in 2009 and I am informed that it has recently undergone a review after being in place for a year and was accepted as working satisfactorily. 

In addition, a Health and Social Services primary and secondary stage complaints procedure has been in place for some time now with good effect.  

This said I am always happy to consider any suggestions that may improve policies and procedures and as such I will instruct the new Chief Officer to review these procedures and I will inform the Assembly if any changes are to be considered.
