A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Chief Minister agreed, on the recommendation of the Minister for Education, Sport and Culture, to approve the appointment of Mr Terence Augustine Le Sueur to the Jersey Teachers’ Superannuation Fund Management Board following the resignation of Mr Peter Robinson, to act as a representative for the Employer side.
Reason(s) for Decision: Article 3 of the Teachers’ Superannuation Fund (Administration) (Jersey) Order 2007 gives the Chief Minister, the Minister for Treasury and Resources, and the Minister for Education, Sport and Culture the power to nominate two representatives from each Department to act for the Employers’ side. The Chief Minister is asked to approve the above person, recommended by the Minister for Education, Sport & Culture, who has the relevant experience to act in such a capacity as outlined in the attached report. This decision follows that of the Minister for Education, Sport & Culture (MD-ESC-2012-0001). The current term of office for the Management Board finishes 31st December 2012.

Jersey teachers’ superannuation fund – board of management nominations

Purpose of Report

1.1. The Chief Minister is asked to approve a nomination to the Board of Management of the Jersey Teachers’ Superannuation Fund.

Background

2.1 Article 3 of the Teachers’ Superannuation (Administration) (Jersey) Order 2007 - requires the following – that membership of the Employer’s side of the Board of Management consists of six representatives in total, two to be recommended by the Minister for Treasury and Resources, two by the Minister of Education, Sport and Culture and two by the Chief Minister.

Comments

Following the resignation of Mr Peter Robinson, Mr Terence Augustine Le Sueur was approached about being nominated by the Education, Sport & Culture Minister in the above capacity:
Mr Le Sueur will be known to Members as a former States Member with particular experience in the field of pensions generally. It is considered that he would bring experience to this role from a variety of perspectives. Having previously been a member of the States Employment Board, and latterly its chairman, he will be aware of the employer's needs in this area. He has also been closely involved with two of the local private schools whose teaching staff are also members of JTSF. His wife is a former teacher and is a beneficiary under the Scheme.

3.3 As President for several years of the Employment and Social Security Committee, and more latterly with the Treasury function, Mr Le Sueur has had many years practical experience in the analysis of actuarial advice and valuations relating to pension schemes, and is well up to date with current thinking in these matters. He was also involved as a political representative on various fund investment sub-committees. Previously Mr Le Sueur spent many years as a practising Chartered Accountant before retiring in 2000.

3.4 The Minister for Education, Sport & Culture agrees that the nominee identified above has the requisite experience, skills and background to act in the capacity of representative of the Employer’s side of the Jersey Teachers’ Superannuation Fund Board of Management and approves their nominations accordingly.

4. Recommendation

4.1 For the Chief Minister to approve the nomination of Mr Terence Augustine Le Sueur to the Jersey Teachers’ Superannuation Fund to act as a representative for the Employer’s side.
