St James Church and Vicarage, St James Street, St Helier: Retained as Site of Special Interest

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Supplementary

This report has been prepared by Jersey Heritage as part of its responsibility under a Service Level Agreement to provide reports and recommendations to the Minister for Planning and Environment on the architectural, historical and archaeological significance of buildings and sites.

Background

MRLAG assessed the church and vicarage in August 2008, when there was majority support (10:5) for listing the church as SSI and unanimous support for listing the vicarage as an SSI. The Jersey Heritage report of 11th August 2008 subsequently recommended listing the site as an SSI. The Minister listed St James Church & Vicarage as an SSI in November 2008.

In July 2010, the minister requested that Jersey Heritage and MRLAG review the listing of St James Church & Vicarage and also consider the registration of St James School (which is subject to a separate report).

MRLAG accordingly discussed the site at its meeting on 11th October 2010. 8 members supported retaining the church as an SSI with 1 member supporting BLI. Members were again unanimous that the vicarage should be retained as an SSI.

Jersey Heritage recommendation

There have been no changes to the architectural and historical interest of St James Church & Vicarage since it was listed in November 2008. It is recommended that the site merits retention as an SSI as set out in the Jersey Heritage report of 11th August 2008 and on the attached plan and schedule (the schedule has been revised to include additional references to surviving architectural features).
