Public Employees (Contributory Retirement Scheme) (General) Regs

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved the draft Public Employees (Contributory Retirement Scheme) (General) (Amendment No. 9) (Jersey) Regulations 200- and agreed that they be lodged au Greffe for debate at the earliest opportunity.

Reason(s) for decision:

  1. To ensure that a Terms of Admission Document, issued when an employer is granted admitted body status into the Public Employees Contributory Retirement Scheme (PECRS), will contain statutory duties on the part of the Chief Minister, the Committee of Management of the PECRs, the actuary and the employer to whom the admission document applies.
  1. Such admission arrangements may be terminated by the employer or the Chief Minister on 6 months notice. This amendment will ensure that any member of the Scheme employed by an exiting Admitted Body will not have his accrued rights transferred out of PECRS to a new employer’s scheme without that individual’s consent. Any such member will have the choice of retaining a deferred pension in PECRS, having a transfer out to an employer’s scheme or a personal pension scheme or having an annuity purchased for him. If no choice is made a deferred pension in PECRS is the default position.
  1. If an admission arrangement is terminated on 6 months’ notice by the employer or the Chief Minister and, the relevant admission document says so, the employer will have to make up any relevant deficit in PECRS assets before the employees exit as a result of that termination. This currently is applicable to Jersey Telecom Limited and Jersey Post Limited only.

Action required: Mrs Byron is requested to arrange with the States Greffe for the Report to be lodged ‘au Greffe’ during the week beginning 5th March 2007 for consideration on the earliest date.
