Road Traffic (St Helier) (Jersey) Order 1996 and Road Traffic (Disabled Persons) (Parking) Order 2005.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):   The Minister approved the recommendations in the Appendix as follows:

  1. Abandon the proposal to introduce motor cycle parking in Patriotic Street;
  2. Move the proposed motorcycle parking 30 metres further north to remain outside the Mourant building but not outside their main entrance;
  3. Establish an unloading bay approximately 10 metres long near to the junction of Halkett Place with Hill Street in place of two of the proposed parking spaces;

and instructed the Law Draftsman to prepare the necessary draft amending legislation.

Reason(s) for Decision: To amend Ministerial Decision MD-T-2008-0093 dated 03 October 2008 following public responses to the consultation phase.

TRANSPORT AND TECHNICAL SERVICES

Purpose of the report  

To consider the results of the public consultation phase that followed Ministerial approval, in principle, of amendments to the Road Traffic (St Helier) (Jersey) Order 1996 and Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2005. 
 

Background  

On 03 October 2008 the Minister approved requests from the Parish of St Helier and Transport and Technical Services under Ministerial Decision MD-T-2008-0093 for amendments to the two Orders, subject to public consultation. 
 

Discussion  

Following the Ministerial Decision public consultation was carried out, jointly with the Parish, in the form of notices posted on street in the locations of the proposed changes to the Traffic Order provisions. The notices were maintained on site for two weeks. Some of the proposals attracted no comment either to the Parish or to this Department. The comments that were received are detailed in the Appendix to this report, together with recommendations that follow a meeting between Parish and Department Officers. 

The proposal to establish an Unloading Bay outside the goods entrance to PBS at Commercial Buildings (that faces south) attracted substantial opposition. A summary of the responses from the public is included in the Appendix, but following Ministerial support and in response to the consultation phase an “Article 68 Notice” under the Road Traffic (Jersey) Law 1956 has been created that will instead establish an unloading bay outside the front entrance to PBS (that faces west) on a trial basis (for up to 12 months), together with the installation of traffic bollards on the corner immediately to the east of the goods entrance to PBS to deter illegal parking on the footway. The details are illustrated on the attached plan. The trial is to commence in early December. 
 

Recommendation  

The Minister is requested to approve the recommendations in the attached Appendix.
