Long-Term Care (Benefits) (Amendment No. 2) (Jersey) Order 2015

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: LONG-TERM CARE (BENEFITS) (AMENDMENT No. 2) (JERSEY) ORDER 2015

Decision(s): The Minister made the LONG-TERM CARE (BENEFITS) (AMENDMENT No. 2) (JERSEY) ORDER 2015

Reason(s) for Decision:

 

This Order increases the standard care fees, the weekly cost of living in an approved home, the weekly cost of incidental expenses and the standard care cost cap by 1.8% from 1 January 2016, in line with the increase in average earnings during 2015. 

 

It also removes the separate rate for the weekly cost for standard care in a group home, which is no longer required.  Individuals receiving care in a group home will receive a benefit in line with their assessed care level from January 2016.

 

Separately, the Long-Term Care Services (Health and Social Services Charges) (Jersey) Order 2015 will increase the charges payable for the provision of long-term care services to a person aged 18 years or over by 1.8% as well, in line with this.

 

This is the first increase since the charges were set on 1st July 2014.

Resource Implications: These changes will increase forecast expenditure from the Long Term Care Fund by about £0.7 million a year from 2016 onwards. 

Action required: Policy Principal to notify the Greffier of the States and the Law Draftsman that the Order has been made so that it may be notified to the States, and forward the signed and sealed Order immediately to the States Greffe for publication and archiving.
