Transfer of Property Maintenance and Associated Property Budgets from the Planning and Environment Department to Property Holdings.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Minister agreed that the budget transfers agreed on 20.8.2008 on Decision Number MD-PH-2008-0082 should also continue for 2009 after which they will be included in the Property Holdings Department Business Plan.   The amounts transferred being:

£3,800     from Planning and Building Services

£(27,855) from Environment

£(4,500)  from Meteorological Services

to Property Holdings being the property maintenance and rental budgets of the above departments.  

From 1 November 2008, Property Holdings will be responsible for the property maintenance of the above Departments subject to a Service Level Agreement.  The full 2008 year to date ledger balances on the agreed account codes will be transferred to Property Holdings as at the transfer date.

Action Required.  Finance Manager of Property Holdings will arrange for the budgets & associated balances to be transferred

Resource Implications:

There are no further manpower or financial implications than those already detailed.

Action required:  The Finance Manager in Property Holdings to prepare the budget transfer

REPORT TO THE MINISTER FOR TREASURY AND RESOURCES  

Transfer of Property Maintenance and Associated Property Budgets from the Planning and Environment Department to Property Holdings, Treasury and Resources Department.  
 

Purpose of the Report  

To seek the approval of the Minister for Treasury and Resources for transfers of property budgets for Planning and Building Services, Environmental Services and the Meteorological Department to Property Holdings. 

Background  

In July 2005 the States agreed the creation of a new States Department, Property Holdings, to be responsible for the ownership and administration of the States property portfolio.  This transfer is an ongoing part of moving the property responsibilities and their associated budgets currently held in other departments into the Property Holdings Department. 

The Departments involved in the proposed transfer are -

02330   Environmental Services

02340     Meteorological Department 

The properties involved in this transfer are-: 

  • Planning Offices at South Hill plus four Portacabins
  • Howard Davis Farm, its associated offices and stores and three houses, two of which are currently let.
  • The Frances Le Sueur Centre
  • Maison St Louis and the associated flat which is currently tenanted

 

As part of their maintenance of public buildings, Property Holdings already maintains the offices at South Hill which are occupied by T & TS, Property Holdings’ Architects Section, and Planning, from whom they receive payment for rent and facilities management.   

This transfer specifically excludes the following - 

  • Kempt Tower - non-property structure
  • The Visitor Centre on Gorey Pier which shares a building with the Customs’ Station. (This is owned by Harbours).
  • The Weather Station at La Moye - treated as plant

 

There are no staff associated with this transfer.

These budgets are insufficient to cover the liabilities and defects highlighted in the condition survey completed recently.  In the first two years of a ten year programme these include -

The under provision of maintenance funding to tackle both backlog and ongoing maintenance is an estate wide issue which will need to be addressed at a corporate level. The Minister is asked to note the shortfall in funding and it is proposed that this should not delay the transfer of resources.  

A corresponding report has been prepared for approval by the Minister for Planning and Environment. The transfer will be actioned when both approvals are in place. 

Recommendation  

The Minister is recommended to approve the revenue budget transfers totalling £(28,555)
