Year End Carry Forwards: 2010 - Fiscal Stimulus and P.64/2010 Article 11(8)

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:   Fiscal Stimulus and P64/2010 Article 11(8) 2010 Year End carry forwards.

Decision(s):  The Minister approved the carry forward of the £3,043,803 available underspend from 2010 to 2011, split by Fiscal Stimulus underspend of £2,811,703 and P64/2010 Article 11(8) underspend of £232,100.

Reason(s) for Decision:  Under Article 15(1)(b) of the Public Finances (Jersey) Law 2005 the Minister for Treasury and Resources can permit all or any part of the amount appropriated by a head of expenditure to, in the case of revenue expenditure, be withdrawn from the Consolidated Fund after the end of the relevant financial year.

Resource Implications: Other than those detailed in the report there are no further financial or manpower implications.

Action required: Head of Financial Performance Reporting and the Fiscal Stimulus Programme Manager to inform departments of the decision in order to transfer the funds.

  1. Purpose of Report

To enable the Minister for Treasury and Resources to approve the carry forwards of unspent funds for P64/2010 Article 11(8) and Fiscal Stimulus approvals from 2010 to 2011.

 

2.   Background

The year end out-turn for the combined P64/2010 Article 11(8) and Fiscal Stimulus underspend is £3 million. A summary explanation for each carry forward can be found in sections 3 and 4 of this report.

 

P64/2010 Article 11(8)

In July 2010 the States approved P.64/2010 lodged by the Minister for Treasury and Resources requesting an additional £15 million to be withdrawn from the Consolidated Fund in accordance with Article 11(8) of the Public Finances (Jersey) Law 2005.  This included £8.5 million to fund 2010 shortfalls in Court and Case Costs across five departments, £6 million to fund the Voluntary Redundancy scheme and £0.5 million to be allocated to the Chief Minister’s Department to fund the delivery of an improved procurement function across the States to generate annual realisable savings.

 

Fiscal Stimulus

In May 2009, the States approved P55/2009 to permit the withdrawal of up to £44 million from the Consolidated Fund to be reallocated for the net expenditure of a number of departments in order to fund a proposed discretionary economic stimulus package.

 

The programme of projects given approval by the Fiscal Stimulus Steering Group (FSSG) continues to deliver benefits to the economy, supporting employment in the Island and creating new opportunities for businesses in Jersey. Some of these projects are unable to meet a conclusion in 2010, therefore a request is made to carry forward those balances agreed but not yet spent.

 

3.   Proposed Carry Forwards – P64/2010 Article 11(8)

The 2010 underspend and proposed carry forwards are as detailed. The Chief Minister’s department have requested £123,000 of the balance to be carried forward to continue with the improved procurement function and Home Affairs have requested the entire £109,100 to be carried forward to fund Court and Case Costs which will fall into 2011. The balance of £76,664 is to be transferred back to the Consolidated Fund along with the £300,000 Court and Case Costs contingency balance held within Treasury and Resources.

5.   Recommendation

The Minister for Treasury and Resources is recommended to approve the following:

 

  • Article 11(8) carry forwards of £232,100, as detailed in Table A
  • Fiscal Stimulus carry forwards of £2,811,703, as detailed in Table B
