Appointment of Chairman of the Jersey Competition Regulatory Authority

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Proposed Appointment of Mr Mark Boleat as Chairman of the Jersey Competition Regulatory Authority (JCRA)

Decision(s): The Minister approved the report and proposition recommending that Mr Mark Boleat be appointed by the States as Chairman of the JCRA.

Reason(s) for Decision: Article 3(1)(a) of the Competition Regulatory Authority (Jersey) Law 2001 requires the Minister to recommend the appointment of a Chairman of the JCRA to the States. 

Resource Implications: The Economic Development Department provides the Authority with a Grant to administer the Competition Law (£400,000 in 2010).  There are no other financial or manpower implications for the States.

Action required: To submit the draft proposition to the States Greffe to be lodged.

Appointment of Chairman of the Jersey Competition Regulatory Authority

PROPOSITION   

THE STATES are asked to decide whether they are of opinion  -    

in accordance with Article 3(1)(a) of the Competition Regulatory Authority (Jersey) Law 2001, to appoint Mr Mark Boleat as a member and non-executive Chairman of the Jersey Competition Regulatory Authority for a period of 3 years with effect from the date of States approval.

REPORT   

The States approved the Competition Regulatory Authority (Jersey) Law in November 2000.  It received Royal Assent on 14th March and came into force on 1st May 2001. 

Under Article 3(1)(a) it is for the States to appoint one member of the Authority as its Chairman upon the recommendation of the Economic Development Minister. Under Article 4(2) a member shall be appointed for a period not exceeding 5 years and upon expiry of such period shall be eligible for reappointment. 

Members will recall that the Assembly and the Island had been incredibly well served by the former Chairman, the Rt Hon the Lord Kingsland and his tragic death in July 2009 precipitated the need for a new appointment.  I should like to put on record my appreciation of the service of Lord Kingsland and that the high regard in which the JCRA is held is in no small measure his lasting legacy. 

The search for a successor to the post of Chairman has been a demanding one.  27 candidates were long-listed, producing a short-list of 9.  These were interviewed in accordance with the Appointments Commission Code and, consequently it is my intention to recommend Mr Mark Boleat, to the Assembly.

Mr Mark Boleat

Mark Boleat graduated from Coventry University in 1970 with a first class BA honours degree in Economics. In 1971 he was awarded an MA in Contemporary European Studies by the University of Reading. He joined the Building Societies Association in 1974, holding a number of positions before being appointed Director General of the Council of Mortgage Lenders when that organisation was created in 1989. In addition, between 1986 and 1989 he held the positions of managing Director of the European Federation of Building Societies and Secretary General of the International Housing Finance Union.  

In 1993 he joined the Association of British Insurers, the largest British trade association, to become its first Director General. In 1999, Mark established Boleat Consulting, a consultancy business specialising in trade association strategy and management and the handling of public policy issues. He has helped establish, merge and reorganise trade associations in a number of sectors. He has also undertaken projects for the World Bank on housing finance in Russia, Nigeria and Egypt, for the International Finance Corporation on Housing Finance in Uganda and for the Government of Jersey on consumer policy.  

From August 2006 to July 2007 he was Head of Claims Management Regulation at the Ministry of Justice with responsibility for implementing the regulatory regime for claims management business under the Compensation Act 2006. 

He is a non-executive director and Chairman of the Audit Committee of the Travellers Insurance Company, Chairman of the Association of Labour Providers and The Green Corridor, Vice Chairman of the Association of Charitable Foundations and a member of the government’s Regulatory Policy Committee.  

He is a member of the Court of Common Council of the City of London where he is Chairman of the Markets Committee, Deputy Chairman of the Policy and Resources Committee and a member of the Police, Planning and Transportation, Standards and City Trust Committees.
