Civil Aviation - Acting Director: Interim Appointment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:   Interim appointment of Acting Director of Civil Aviation

Decision(s): The Minister for External Relations, in accordance with Article 5 of the Civil Aviation (Jersey) Law 2008, appointed Thomas Fergus Woods as interim Acting Director of Civil Aviation for the period until a new Director of Civil Aviation is appointed to the office.

Reason(s) for Decision:

The Director of Civil Aviation (DCA) for Jersey and Guernsey gave notice of his retirement with effect from 16 June 2014.  A new appointment will be made, jointly with Guernsey, to take up office from the beginning of August 2014.  In the interim, the former DCA is eligible to hold the office and has agreed to provide interim cover to ensure there is no regulatory hiatus.

In order to ensure the continuity of regulatory cover, this Ministerial Decision is effective from 16 June 2014.

Resource Implications: There are no additional resource implications.

Action required: External Relations shall –

(1) inform the States Greffe of the decision and

(2) notify the Acting DCA of his interim appointment.

Interim appointment of Acting Director of Civil Aviation

The Director of Civil Aviation (DCA) for Jersey and Guernsey gave notice of his retirement with effect from 16 June 2014.  A new appointment will be made, jointly with Guernsey, to take up office from the beginning of August 2014.  In the interim, the former DCA is eligible to hold the office and has agreed to provide interim cover to ensure there is no regulatory hiatus.

The Civil Aviation (Jersey) Law 2008, makes provision in Article 5 for the appointment of an Acting DCA whilst there is a vacancy:

5 Acting appointment

(1) This Article applies while –

(a) the person holding the office of Director of Civil Aviation is unable to discharge the functions of the office; or

(b) there is a vacancy in the office of Director.

(2) The Minister may appoint a person to discharge the functions of the office of Director.

(3) The person must be eligible to hold the office of Director.

The Acting DCA will continue to provide interim regulatory cover for Jersey, on the same terms as his previous appointment, until the new permanent DCA takes up office.
