Information about the publication of Ministerial Decisions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

1. The Minister decided, as recommended by Jersey Property Holdings, to notify the States of his intention to:

rescind previous decisions MD-PH-2011-0133 and MD-PH-2012-0008;
to take ownership, from the Parish of St Helier, of the section of Oxford Road co-extensive with the Millennium Town Park, as shown coloured green on the attached plan and measuring approximately 261.0 sq m.

to transfer to the Parish five strips/parcels of land co-extensive with Gas Place and Oxford Road (part), as shown coloured red on the attached plan and measuring in total approximately 242.4 sq m;

both transfers being at nil cost, and with each party to meet their own costs in connection with the contractual arrangements;

to confirm the above decision after giving the States 15 working days’ notice of the transaction, and to cause the transaction to be completed

Reason(s) for Decision:

1. Under Standing Order 168 (1) (a) the Minister is obliged to notify the States that he has accepted the recommendation of Jersey Property Holdings to agree to the above land transaction.

There are no manpower implications in respect of this decision.

When the sale is concluded the States asset balance sheet will be amended to account the transaction

Action required:

In accordance with Standing Order 168 (3) this decision must be presented to the States at least 15 working days before the contract is passed. After the expiry of 15 working days following presentation to the States the transaction may be concluded.

The Director of Jersey Property Holdings is to copy this decision and the accompanying report to the Connétable of St Helier.
