Jersey Child Care Trust: Appointment of Chairperson

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Appointment of the Chairperson of the Jersey Child Care Trust.

Decision(s):

Having decided to present a Report to the States, giving 15 days notice of his intention to appoint Marnie Baudains as the Chairperson of the Jersey Child Care Trust in pursuance of paragraph 5.1 of the Trust, as amended by the Royal Court on 21st June 2012, the Minister has now decided to make the appointment in accordance with the revised procedures for public appointment laid down in P205/2009 approved by the States on 2nd February 2010.

Reason(s) for Decision:

In pursuance of Paragraph 5.1 of the Trust Constitution, recently amended to take account of revised procedures for public appointment laid down in P205/2009 approved by the States on 2nd February 2010, the Minister is required to give the States 15 days notice of his intention to appoint Marnie Baudains as Chairperson for a period of 3 years, before confirming the appointment.  The Minister informed the States of his intention to make this appointment in R.89/2012 on 4th July 2012 and therefore he has now made this decision to confirm the appointment. All the Trustees support her re-appointment and the recruitment process was carried out in partnership with the Jersey Appointments Commission.

Resource Implications:

There are no resource implications to the Home Affairs Department resulting from this decision.

Action required:

The Assistant Director of Education to request the Greffier of the States to arrange for the attached Report to be placed before the States.

Decision to Appoint a New Chairperson

 

At its meeting of 18th February 1997, the States adopted a proposition of the Education Committee (P24496) and approved the setting up by the States of a Child Care Trust to co-ordinate, promote and facilitate expansion of child care provision in the Island.

 

Following registration of the Trust’s Constitution before the Royal Court on 5th December 1997, the Trust has supported the development of significant advances in the range, quality and quantity of child care places available for children aged up to twelve years, and has formed a close and working relationship with other agencies, both States and private, which are concerned for the welfare of children.

 

For 12 years, since January 2001 when the States  approved his appointment on the recommendation of the President of the Education Committee, the Trust has been most ably lead by Mr Colin Powell CBE who served 3 terms of office in the role and therefore, under the terms of the Constitution, is not able to continue. The Minister for Education, Sport and Culture wishes to thank Mr Powell most sincerely for his considerable drive, commitment and influence during this period and to express publicly the view that his skills and determination have been critical in establishing the strong and respected position which the Trust now holds.

 

In pursuance of Paragraph 5.1 of the Trust Constitution, amended by the Royal Court (21st June 2012) to comply with revised procedures for appointment laid down in P205/2009 approved by the States on 2nd February 2010, the Minister in R.89/2012 (4th July 2012) gave the States 15 days notice of his intention to appoint Mrs Marnie Baudains as Chairperson for a period of 3 years.  Mrs Marnie Baudains is the former Directorate Manager of Social Services. She has a broad experience in management within the public sector, a sound grasp of social, education, and health issues and has a lifelong commitment to the welfare of children. The Minister is confident that Mrs Baudains will bring her experience and expertise to bear and will be an exemplary leader in this important role. Mrs Baudains’ appointment to this post is supported by the JCCT Trustees and the recruitment process was carried out in partnership with the Jersey Appointments Commission.

 

In accordance therefore with the revised procedures for appointment laid down in P205/2009 approved by the States on 2nd February 2010, described above, having given the required notice, the Minister has now decided to make the appointment with immediate effect.
