Jersey Arts Trust : Re-appointment of Chairman

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Renewal of the term of office of Mr Alan Le Breton as chairman of the Jersey Arts Trust

 

 

Decision(s):  Having received the advice of the Jersey Arts Trust, the Minister approved a draft proposition reappointing Mr Alan Le Breton as the chairman of the Trust for a second four-year term of office.

 

 

 

Reason(s) for Decision: The constitution of the Jersey Arts Trust requires the endorsement of the States to the proposal made by the Minister following consultation with the Trust.

 

 

 

Resource Implications:  There are no resource implications.

 

 

 

Action required: The Minister instructed that the proposition re-appointing Mr Le Breton be lodged for debate as soon as possible by the States.

  1. Introduction

 

This report concerns the re-appointment of the Chairman of the Jersey Arts Trust, Mr Alan Le Breton, for a second term as permitted under the Trust’s constitution.

 

  1. Background

 

Mr Le Breton was appointed by the States on 21 July 2010, following a selection process overseen by the Jersey Appointments Commission.  His period of office has come to an end and the Trust has approached the Minister to request that his term be extended for a further four-year period.  Mr Le Breton has indicated his willingness to continue.

 

Mr Le Breton has overseen a period in which the Trust has developed its role and influence within the Island to considerable effect, attracting financial support from a number of sources in addition to the DfESC.  He has also engaged positively with the Department over the arts review, the conclusions of which are shortly to be available.

 

  1.    Next steps

 

The appointment of the Chairman of the Jersey Arts Trust requires the approval of the States of Jersey. A draft proposition is attached which includes Mr Le Breton’s curriculum vitae.

 

  1.    Recommendation

 

It is recommended that the Minister agree to Mr Le Breton’s re-appointment and that the proposition be lodged for debate.
