Oakfield Building, Highlands College - 21 year lease.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Property Transaction for Ministerial Decision - Minister for Treasury and Resources

Oakfield Building , Highlands College , St Saviour – 21 Year Lease to The Jersey Employment Trust

JQ 5/116/6

Purpose

To request that the Minister for Treasury and Resources considers an adjustment to an earlier Ministerial Decision (Decision Reference MD-TR-2006-0007) dated 9 January 2006.

Background

On the 9 January 2006, the Minister for Treasury and Resources agreed to a lease to the Jersey Employment Trust for a certain area of land at Highlands College, St Saviour for a period of 21 years at a commencing rental of £8,000.00 per annum.

The agreed let area was approximately 14,656 square feet comprising an enclosed space of approximately 11,555 square feet being “the shed”, and circulation/parking space totalling approximately 3,100 square feet.

Current Situation

In drafting the lease it has become apparent that to consider only the footprint of the building (and circulation/parking area referred to above) as the total extent of the demised would, from a conveyancing point of view, be impractical. Numerous windows and doorways open out from the building and a fire escape which exits from the top floor of the building has been constructed so as to fall onto Public land.

Recommendation

It is the recommendation of Property Holdings and the Law Officers’ Department that to remedy these potential encroachments, the path and grassed embankment (illustrated for identification purposes only in dark shade on the attached plan 5/116/6) which borders the site should be included within the lease as a part of the demise. The proposed additional area is unused by the Public, has no discernable value and no additional charge would be levied for its inclusion in the lease.
