Road Racing (Motor Vehicle Rally) (Jersey) Order 2008.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

TRANSPORT AND TECHNICAL SERVICES  

THE JERSEY MOTOR CYCLE AND LIGHT CAR CLUB’S APPLICATION FOR THE JERSEY CAR RALLY 2008  
 

Purpose of the Report  

To obtain a Ministerial Decision regarding approval of the Jersey Motor Cycle and Light Car Club proposed Jersey Car Rally.  
 

Background  

The promoter (The Jersey Motor Cycle and Light Car Club) has submitted details of its proposed route stages for the 2008 Jersey Car Rally (see attachment), to take place on 10th and 11th October 2008. The event is enabled by Order of the Transport and Technical Services Minister under Article 2 of the “Motor Vehicle Races (Jersey) Law 1946”.  

The proposed routes for the Rally have been approved by the Connétables of each relevant parish and the Fire and Ambulance Services. The promoter has also carried out consultation with all residents who will be affected by the chosen routes. The promoter has also supplied proof of Public Liability Insurance.  
 

Discussion  

Of the nine stages proposed this year, ‘Stage 1’ in St. Ouen’s Bay is new (using Le Chemin des Basses Mielles, Le Mont a la Brune, Le Mont Fondan, La Rue du Val de la Mare du Sud and La Rue de la Mer). With this exception all remaining stages have been utilised in the last two to five years. 

Of the various main road sections included in the event this year, most significant in respect of traffic impact will be the closure of: 

  • La Rue des Mans (B25) and La Route du Francfief (B43) during Stage 3 (between 12.30pm and 5.30pm on Friday 10th). During this time access to Les Quennevais will be maintained via Beaumont (A12) and St. Aubin’s Hill (A13);

 

  • The Esplanade for the Starting / Finishing Ceremony (at 9.45am on Friday 10th and again at 6pm on Saturday 11th for one hour)

 

Bus services will not in general be affected.  However, the No. 8 will be required to access the ‘Living Legend’ via Le Mont de L’Ecole rather than La Route de L’Aleval (‘the German Road’) which will be closed during Stage 6 (between 7.45am and 12.45pm on Saturday 11th).  

Otherwise stages have been designed to minimise their impact on traffic and bus services. 
 

Recommendation 

The Minister is recommended to approve the Road Racing (Motor Vehicle Rally) (Jersey) Order 2008 as prepared. 
 

Action Required 

Advise the Greffier that the Order has been made and forward the Decision Summary and Report, together with the signed and sealed Order to the Publications Editor at the States Greffe.
