East of Albert Development Plan funding

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

A decision made (06.03.06) to approve a budget transfer from Central Planning Vote to provide 50% of the funding for Stage 1 of the East of Albert Development Plan.

Decision(s):

The Minister decided to approve, in principle, a budget transfer of £200,000 from the Central Planning Vote (Business Unit FXN900) to provide 50% funding for Stage 1 of the East of Albert Development Plan, subject to the endorsement of the Council of Ministers to the steering group proposals.

Reason(s) for decision:

A masterplanning approach is required for the area to the East of Albert Pier, incorporating the La Collette 2 reclamation site. The senior officer steering group, headed by the Chief Executive, is proposing a two stage approach.

Stage 1 will cover:

· Background Research

· Land Assembly Proposal

· Traffic Report/Scheme Proposals Development

· Risk Analysis

· Provisional Land Use Concepts

· Provisional Viability Appraisals

· Strategic Supplementary Planning Guidance

· Strategic Options for Implementation Approach/Vehicle

at an estimated cost of £400,000. Stage 2 will produce a detailed masterplan/business plan.

Part funding of £200,000 for the first stage has been identified from existing Harbours, Economic Development and Transport and Technical Services budgets. The balance of £200,000 can be met from within the Central Planning Vote.

The proposals are to be considered by the Council of Ministers at its meeting of 9 March 2006.

Action the budget transfer, should the Council of Ministers endorse the steering group’s proposals
